Hi
I have received quite a few letters from Moriarty Law company saying I owe money to AOL now Talk Talk, from about seven years ago and i did used to have AOL internet then but i cancelled it as the service was not good and it was cancelled in a correct procedure ( cancel request mac code etc). I asked for proof of the debt as they sent me a couple of pieces of paper with payments that i had made back then but not the paper work where they say i dint pay. I asked for more proof and they said that's all their client has for the account. Now they have asked me to pay £50 a month with out me agreeing to this.
any advice would be truly grateful.
P.S They sent me a court date letter but it didn't look real if you know what i mean.

    If no payments or written acknowledgement has taken place in 7 years, the debt will be statute barred by now, limitations act gives a creditor 6 years to chase an old debt.


    You mention a court letter, what exactly have they sent you ?


    In any case, you should complete and send this letter to Moriarty Law ASAP :

    thanks for information, nothing to complete on the form just a date which has now passed and Moriarty Law debt collectors has now decided i will pay 50 pounds a month.

    Are you 100% certain they have not obtained a CCJ (county court judgement) against you, have you checked your credit files ?


    If they have not taken legal action, it will be statute barred, which means they cannot continue to try collection of the debt, you should send the letter, and hopefully that will be the end of it.

    when they sent a court letter with a date , i wrote to them explaining i didn't owe the money and would like more proof of the debt. they then wrote to me saying they were going to freeze the account until they get more proof. they sent me 2 pieces of paper with record of payment i made to AOL ( just regular payments for my internet). i asked for more as this didn't explain my debt , the reply was they didn't have anymore records than this. no new date for the court just a letter requesting 50 a month also saying that their client was legally due the money.

    Right, OK, then you should send the statute barred letter.


    They are just chancing their arm hoping you are unaware of the limitations act, and your rights under it.


    This is a common occurrence from companies such as this.
