Letter from Aviva

Many moons ago I used to be a self-employed IT contractor, being the sole director of a Ltd Company.

During this time I set up an Executive Pension Scheme with Commercial Union (later Norwich Union and then Aviva) and my company paid in contributions every month.

In 2004 I closed down the Ltd Company as I had gone back into permanent employment but I left the pension with Aviva and no further contributions have been made.

Yesterday I received a letter from Aviva (addressed to the "Company Owner") telling me that the existing pension scheme is not compliant with AE and that I need to do something about it. They are suggesting that I transfer it to one of their compliant schemes, but do I need to do that if the company is closed down?

  • If there is no company, what exactly would be automatically enrolled?

    I suggest telling Aviva that the company is closed and asking if "doing nothing" would be sufficient, since I suspect they think the company is still extant.
