     you have my email addy but nowadays you never respond .. why not ?
    I am working full time and am also utterly fed up with this silly game and have no reason to want to discuss it yet again. 

    Totally pointless and we don't want updates which would encourage others to chase off on the same wild goose chase.
    Oh dear ???   well, I do not play silly games, nor do I send anyone on a wild goose chase.
    Helping people is my aim ... not knocking them.

    Sorry you feel that way but as I said your not being very polite with your replies so don’t know why you would help others for free if it annoys you. Feel free to remove yourself from this thread but I will be looking for further help if that’s in letters or emails that I receive and also when or if it goes to court. As you can imagine if this was to happen to me or others this would be quiet an alien experience and help would be much appreciated and needed.

    The responses from BW do not, in my opinion and others, do anything to assist. They are pretty much useless and courts know these added amounts do not have a lawful basis, and strike them out. However BW will keep adding them, because it is clearly worth their time to chance it - we know how few people defend, let alone know how to defend properly, and so they make a profit. 
    The only way to stop this happening across the board would be 
    - a JR on the legaltiy in total. Costs 5 figures min.
    - civil restraint order, which will cost 4 figures if you can get a court to hear it.

    We all know that the BWLegal responses are a joke. 
    But the more you reply, the more nonsensical their reply is and they set the scene for the hanging judge.

    Good Afternoon

     

    Thank you for your recent email, the contents of which have been noted on file. 

     

    Our Client's cause of action is that you breached the Terms and Conditions of the contract which you entered into by parking your vehicle in the car park, by failing to validate stay or make a valid payment.

     

    Our Client is pursuing you as the Registered Keeper of the vehicle. 

     

    The vehicle was observed at Canvey Island car park on 16 August 2020. The vehicle was observed by the Automatic Number Plate Recognition cameras (‘ANPR’) entering the site at 13:55 and leaving at 19:24.

     

    The Parking Charge Notice (‘PCN’) which you have been issued with is for a breach of contract. The only right which you have to enter the land in question are on the terms and conditions which apply. The signage at the car park is prominent and the terms and conditions are clearly displayed. It is unnecessary to apply an analysis of offer, acceptance and consideration quite simply because the contract was formed on mutual promises. By parking your vehicle in the car park you have entered into a unilateral contract with our Client. Acceptance does not have to be communicated, the act of parking your vehicle is acceptance.

     

    We can confirm that you previously appealed this matter with both our client and the independent appeals service POPLA, who rejected your appeal. Considering that you came to the end of the appeals process and were advised that the PCN was issued correctly, you were given the opportunity to pay the parking charge of £100.00 before our client instructed ourselves to recover the outstanding balance.

     

    The signage in situ makes provision for our client to recover any additional costs (Contractual Costs) incurred by them in relation to the PCN. The Contractual Costs referred to form part of the terms and conditions (of the parking contract) which were accepted by you in the course of staying at the Car Park. Save for the fact that the sum of [£60.00] attributable towards these costs are entirely reasonable for the nature and type of work involved in recovering the parking charge, such costs are recoverable under the relevant parking code of practice.

     

    Under the BPA Code of Practice, Part B, Section 23 - Recovering unpaid parking charges states, “Where a Parking Charge becomes overdue and before Court Proceedings have commenced, a reasonable sum (which covers the cost of recovering debt) may be added for the debt recovery fees. This sum must not exceed £70 unless prior approval from the BPA has been granted.”.

     

    We are not obligated to provide any documentation proving that we are authorised to add recovery costs to the parking charge, the above outlines the contractual costs for breach of the terms and conditions of the car park and makes clear that the costs are entirely reasonable.

     

    The outstanding balance of £160.00 remains due and owing.

     

    What to do next

    Our Client is willing to resolve matters with you on an amicable basis, however, this is contingent on you making immediate arrangements to repay the Outstanding Balance Due within 14 days.

     

    If you cannot afford to pay the Outstanding Balance within 14 days don't worry, Our Client may be willing to accept repayments of the Outstanding Balance at an affordable rate each month.

    Same old stuff from BWLegal ......... It is very sad that BWL don't understand that the BPA code of practice is NOT A LAW and has nothing to do with the motorist.

    You have asked BWL what is their legal authority to add £60 and what is their clients legal authority to add £60. ??  BWL HAVE FAILED TO EXPLAIN THE LEGAL AUTHORITY and just use a very feeble excuse that the code of practice says they can.   Even a county court judge could not be held liable on what is basically heresay and not applicable to the motorist

    You have given BWL enough warnings as to how this will proceed.  That is you will query any signed statement of truth by BWLegal for claiming a further £60 which goes behind the ruling of the Supreme court.

    You will ask the court to strike out the claim for being unreliable and a poor attempt of double recovery which is in turn abuse of process

    The above letter from BWLegal is just begging for money which you do not owe.....

    Just wait to see if they issue a letter before claim giving you 30 days to respond. Then you can remind them all over again that they have failed to provide their LEGAL AUTHORITY and the claim is unreliable to which you will ask the court to strike it out.

    Over to BWLegal now, they can tell the judge. they have a lot of history on these fake charges
