Guys, kinda desperate here.
I ordered a sofa with Harveys back in February, and obviously COVID meant production stopped for a long period. They key messing me around with dates for delivery and was eventually put back to August at the earliest so i cancelled the order. They said to wait 30 days to get the money back - which evidently is monday next week. With the news of their administration coming today, where do I stand? Will I get a refund still? They say they will honor orders, but what about refunds? I paid in full (£1800) with a debit card (monzo). Can I start a clawback? If so do i start it now?

My first flat has been a nightmare, cant deal with sitting on an inflatable sofa much longer and dont have the money to rebuy again...stressed isnt the word.

    Chargeback with your bank. There's a 120 day limit but it typically starts from when the goods were due to be delivered so you should be okay.

    Thanks @unholyangel - would this still work even if Monzo in this case would not be able to get the funds back from Harveys?

    No reason it shouldn't. The banks (both yours & the retailers) have agreed to visa/mastercards scheme rules when signing up to use their services.

    I have had a sofa from harveys from last sep broke after 5-6 weeks under warranty. Took weeks for it to be inspected to say sofa was faulty which was confirmed. Then told it would take 12 weeks or so for the repair to be done then lockdown has happened now administration. Home serve are saying they have not recieved the part from harveys. I was told if it was not fixed within 3 months by rights I could have the sofa replaced. Can anyone help where this leaves me? Paying creation £50 per month and also for insurance policy.

    We are in the same boat as JamieJ89. We order a three seater sofa, a two seater sofa, a chair and a stool from harveys on 2nd February, it was a 16 week delivery which should have taken us to 23rd May.  We have not had any correspondence from them until I emailed. I got a reply two weeks later to say that due to the coronavirus manufacturing was delayed. When my husband rang them, last week, after several attempts and a 56 minute wait, they said there were honouring our contract with them. However, today I read in the paper that they have gone into administration, along with Bensons for Beds, who we also placed an order with. The difference being I received an email from Bensons about an hour ago to say they would still be delivering once the item is in stock in the warehouse.
    Can I cancel my order with Harveys and get a refund or do I have to go through the credit card company to get our deposit refunded?

    Bensons for Beds are still trading. It seems the holding company placed them in liquidation and then bought them back (wiping off some of tewhir debt|)  Harveys is in adminsitration  PWC are administrators and say you will get your sofas, but you won't get a refund if you cancel the order

    Are Harveys and Bensons continuing to trade?

    • Yes. Both businesses are continuing to trade and most stores are open as normal.

    • The Harveys furniture business is continuing to trade in administration under the supervision of the joint administrators with a view to selling all existing stock. 

    • The Purchasers are continuing to trade Bensons for Beds following their acquisition of the business from the joint administrators.

    I have already placed an order. Will it be delivered? 

    • The Purchasers have undertaken to honour all outstanding customer orders placed before 30 June 2020. This applies to both Bensons for Beds and Harveys Furniture customers. Your order will be honoured unless otherwise informed by the Purchasers

    • You do not need to do anything now. You will be contacted in due course regarding completion/delivery of your order.

    • If you do have any queries about any order placed before 30 June 2020, you can contact Bensons at 0333 222 6800   /  [email protected] for further information. 

    I paid a Deposit. What will happen to it?

    • Your deposit is safe. The Purchasers have said they will honour existing orders as at 30 June 2020, including deposits paid.

    • You do not need to do anything now. You will be contacted in due course regarding completion/delivery of your order.

    • If you have any queries about your any order placed before 30 June 2020, you can contact the Purchasers of the Bensons business at 0333 222 6800 / [email protected] further information. 

    Can I cancel my outstanding order?

    • All existing orders for both Harveys and Bensons are being honored by the Purchasers of the Bensons business. If you wish to cancel orders you can contact the Purchasers on at 0333 222 6800 / [email protected]

    Contact creation - you can make a s75 claim (section 75 of the consumer credit act). This basically gives you the exact same rights against the credit company that you would have against harveys.

    I'm sorry, JamieJ89.
    I didn't see this thread until after I posted my own re' Harvey's Administration.
    Luckily, I DO have 2 sofa's to sit on, although one is not as ordered and doesn't match the other one! I've been passed from pillar to post, without resolution. I also paid in full by debit card, so am going to give chargeback a go......if and when I can get through to my bank!!

    Just by way of an update, I contacted the customer services team of Harveys yesterday at 9am and they said that very little information was known at the time, and that I should contact the store I purchased the sofa from for an update.

    I did, and a very helpful man took my number and said he would look into it - he said it was the first day that the store had reopened, and that very little information was known about what would happen to my refund. Anyway, he called back this morning and confirmed he was able to refund me - so he took my card details and processed the refund there and then! Happy days, a good resolution for me personally.
