Please Help People!

Right, in July 2007 i purchased a camera on eBay brand new from a business seller - bad idea never again.
It went wrong a few months ago it is a problem other people have had aswell, its almost like something has come loose and it vibrates unable to focus so is unusable.
So i contacted the seller, he eventually agreed to send it away, about 5 weeks later i got it back and it is still not working and the problem seems to have worsened. He refunded postage to Hong Kong where it was sent to the suppliers, but is not responding to any of my messages describing the problem i am still having with the camera. I am sure im entitled to something. If anyone has any advise id really appreciate it because ebay can only suggest getting the sellers contact info but the listing has expired so I cant even do that. PLEASE HELP ME !

Im not sure about exactly where you stand but I would imply in your next message that if not resolved you may need to contact Ebay. This may spurt this seller into life!! The more experienced users on here will be able to tell you the legal or official position you are in but if he is not responding he needs a prod with next message

July 2007? The seller is only liable under law for 6 months from purchase so you are very lucky to get a P&P refund. After 6 months its for you to claim from any manufacturer's warranty directly. No warranty = buy another one.
  • The listing Im sure stated 1 year suppliers warranty. Also how do you go about claiming to the manufacture directly?

If it stated 'suppliers warranty' that would be quite unusual, but a few sellers do directly provide a 1 year warranty. Usually it will say '1 years manufacturers warranty' - check his recent listings?

A supplier is not responsible for a manufacturers warranty.

As you dont have a copy of the listing = your warranty then I dont see you can easily enforce a claim against the supplier.

Manufacturer warranty details (if one exists) would be supplied with the product.

As it is nearly a year since purchase, your ebay and paypal options have long since expired, and I think even the option of a credit card chargeback has long since passed.

Modern digital products are generally considered as disposable now - it costs that much to repair them it is rarely financially viable to offer a repair service, and given how quickly cameras improve with features, a similar camera at today's prices would be a fraction of what you paid a year ago.

It may well be cheaper to cut your losses (and stress levels!) and buy a new one - £30-£40 gets something very usable, and £75-£100 gets a good decent spec.

  • His recent listings say 1 year suppliers warranty .. yea i dont think i have a manufacture warranty il have to have a look. and i have no copy of the listing as i didnt know ebay deleted them after a certain amount of days. so i have no case then. it really has annoyed me the camera cost the best part of 200 quid and it should last longer than a year.
