Terms & conditions (the ‘Rules’) for the free prize draw relating to the ‘Superhero Movie’ / Yates’s Bar promotion (the ‘Prize Draw’).
Please read these terms and conditions carefully before submitting your entry. By submitting your entry, you are agreeing to adhere to, and be bound by, the Rules.
1. No purchase necessary – free prize draw.
2. Participants can enter either by sending a text message or applying online.
3. Closing dates 08.06.08 for text entries and 20.06.08 for online entries.
4. Winners will be selected at random from all entries received.
5. Offer open to residents of England, Scotland and Wales only. Entrants must be eighteen (18) years of age or older at the time of entry into the Prize Draw.
6. Text entry route: participants should text SUPERHERO to 81123. Only one entry per mobile phone number is permitted. Text entries are charged at entrant’s standard network charge. To receive further offers from STA Travel and Momentum Pictures, entrants should also include their email address within the text message. Entrants should ensure that they have the bill payer's permission before sending a text entry. In the event it is discovered that any individual attempted to enter the Prize Draw more than once from any particular mobile phone number, all of the individual’s entries will be disqualified from Prize Draw. All valid text entries received before the end of the Prize Draw Period will be entered into the prize draw. Entries received via text after the closing date will not be counted but may still be charged. Every valid entry will receive one bounce-back text message within 24 hours as confirmation of entry in the prize draw. The Promoter is responsible for the cost of this entry acknowledgement. Closing date for text entry is 8.06.08
7. Online entry route: participants can also apply for free by visiting www.statravel.co.uk/superhero. Closing date for online entry is 20.06.08.
8. All entries submitted before the closing date will be entered into the prize draw. All entries are subject to verification by Promoter and Promoter reserves the right to cancel and revoke any entries if they are found to be improper or if the entrant is subsequently found to be ineligible pursuant to the Rules.
9. All data collected will be for the sole purpose of this Prize Draw and will not be passed on to third parties or used for any other purpose (other than text entrants including their email address, who in so doing, consent to being contacted by email by Promoter and STA Travel with relevant information and offers) and by entering the Prize Draw and voluntarily providing your personal information (including, but not limited to telephone number) (collectively “Personal Information”) you consent to such collection and use of the Personal Information by Promoter.
10. Proof of sending a text entry is not proof of receipt by the Promoter. The Promoter accepts no responsibility for any entries that are lost or delayed, whether due to lack of network coverage or any other technical reason beyond the Promoter’s control.
11. By submitting an entry, entrants agree to be bound by these Rules. Any breach of these terms and conditions by the winner may result in the forfeiture of the prize. Interpretation of the Rules by Promoter shall be final.
12. The draw for the Prize from all eligible entries received will be held in London on 14 July by an independent third party. A qualifying entry and/or entrant may only win once. Winners will be notified by 14 July, 2008 by phone or email.
13. Prize must be claimed by 11/08/08. Prize must be booked by 30/09/08
14. There is one prize, which comprises: two (2) economy flights for two (2) adults from London Heathrow to JFK Airport, New York; three (3) nights' accommodation for two (2) adults at the Jazz Hostel in New York, based on winners sharing a twin bedroom; two (2) flights from JFK Airport, New York to Los Angeles International Airport (LAX); three (3) nights' accommodation for two (2) adults at the Orbit Hostel in Los Angeles, based on winners sharing a twin bedroom; a skydiving experience for two (2) adults and standard travel insurance. Prize does not include transfers to/from hostel/airport. Winner and guest must both be 18 years of age or older and hold a valid passport.
15. The Prize will be provided by STA Travel. Travel details are subject to change upon notice. STA Travel is the prize coordinator only and is not responsible for actions and/or policies of the travel suppliers providing elements of the Prize. Winner and winner's guest must travel on identical itineraries. Selected winner is responsible for paying all taxes and applicable fees which must be paid at the time of booking, and any additional charges that might arise, including but not limited to, additional ground transportation (other than those specifically agreed to above), VAT and all other such taxes, travel, repatriation and health insurance, personal expenses (and other items of a personal nature), gratuities, meals (other than those specifically agreed to above), entertainment, etc.
16. Any lost or stolen tickets, travel vouchers, certificates or any other property will not be replaced. Tickets are subject to seat availability on the day of departure. Bookings are made on a space available basis. All bookings must be made through STA Travel or its designees. No changes to travel dates or passenger names are permitted once the booking has been confirmed. The Prize cannot be used in conjunction with any other promotion or offer. Holiday and other blackout dates and other restrictions may apply and all bookings are subject to availability.
17. The Promoter reserves the right to cancel, amend, terminate or temporarily suspend this promotion in the event of any unforeseen circumstances outside its reasonable control, with no liability to any entrants or third parties.
18. In the event that the Promoter is unable to make contact with a winner within 28 days, the Promoter reserves the right to re-draw the prize, in which case the original winner will forfeit any claim to a prize.
19. Prize is non-refundable or transferable.
20. There is no cash alternative for the Prize or any unused portions thereof. Promoter shall not be liable to the confirmed winner of the Prize for any guarantee, warranty, condition or representation, express or implied, relating to the Prize, including without limitation, its quality, condition or fitness for a particular purpose.
21. In the event that the Prize is unavailable it may be replaced by one of equal or greater value.
22. The Promoter's decision is final and no correspondence will be entered into.
23. The draw is not open to employees of officers and directors of Promoter, STA Travel, Yates's, their advisers, assignees, agents, licensees, media buying and promotional agencies, or a member of such person's immediate family or household. Travel Excludes Christmas, Easter, New Year and Public Holidays.
24.
a) Once contacted, a selected entrant must, in order to be declared eligible to receive a Prize:
i) comply with all Rules;
ii) sign Promoter’s standard declaration of compliance with the Rules, release and consent to publicity form (the “Consent”), which shall serve as the selected entrant’s agreement to, to the extent permitted by law, release and indemnify Promoter and its parent(s), subsidiaries, affiliates and/or related companies and each of their officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising, media buying and promotional agencies from any liability in connection with the Prize Draw and/or the prizes. If Promoter does not receive a signed Consent back from the selected entrant within five days from the delivery of the Consent to the entrant, then such entrant shall forego any right or entitlement to the Prizes and another winner may be drawn.
b) Promoter shall not be responsible or bear any liability for:
i. late-received, lost, unintelligible/illegible, falsified, incomplete, destroyed or misdirected entries;
ii. entries which fail to comply with the Rules; and,
iii. any failure of the website / text mechanic during the Prize Draw Period, including any problems or technical malfunction of any computer on-line systems, human error, servers, access providers, computer equipment, printing errors, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, delayed or garbled data or transmission, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from downloading any material in the Prize Draw, all of which may affect an entrant’s ability to participate in the Prize Draw.
c) Save in respect of Promoter’s liability for: (i) death or personal injury resulting from Promoter’s negligence; (ii) fraud or fraudulent misrepresentation on the part of Promoter or (iii) any other liability that can not be excluded by law, Promoter accepts no responsibility for losses, damages or claims caused by or resulting from the Prize Draw.
d) By participating in the Prize Draw, the Prize winner agrees that his/her name, residence, photograph, voice and/or image may be used in any and all forms of media, without any further compensation by Promoter and waives all rights (including moral rights) with respect to printed, broadcast and other forms of publicity.
e) Promoter may, acting in a commercially reasonable manner or for any circumstances beyond Promoter’s control, terminate the Prize Draw at anytime or may amend the Rules or administration of this Prize Draw without notice in Promoter’s sole discretion.
f) In the event of a dispute as to who submitted an entry, the entry will be deemed to have been submitted by the authorized account holder of the telephone number or email account submitted at the time of entry.
g) Any person who is not a party to this agreement may not enforce any term of it and the provisions of the Contracts (Rights of Third Parties) Act 1999 shall not apply.
h) These Rules shall be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.
