Hi everyone
I checked out this site as my partner is currently in the process of reclaiming bank charges and thought i might try for some advice here on our problems.
Any advice would be so so so so appreciated and thank you so much if you decide to take the time to read our dilema. Its a bit of a waffle but we desperately need advice. Really.
PROBLEM 1:
My parents with whom i currently live with are desperately looking to sell their house and move away from our town for a better quality life to say the least!. The problem is that we have the neighbours from absolute hell. Last year we had many problems, including noise from them etc escalating. We reported them several times to the council which they did not like (probably due to them being benefit frauds and drug dealers!.) So things turned nasty. My parents work very hard, always have and have to get up very early in the morning. They made the now obviously terrible mistake of buying the house in this 'area' 12 years ago. Anyway, after problems escalating, three men came round and beat my dad up putting him in hospital. Punched me, my young sister and mum. We all needed stitches or treatment of some sort. They also 'bricked' our windows. They got clean away with it. The police couldn't or wouldn't do anything. My mum and dad are both in their late 50's!. My question is, does my mum and dad have to declare that this incident happened when putting the house up for sale? And how much would they lose because of it? The police and law say it never happened basically right? (as nobody was arrested even, or charged). It was over a year ago now. Also, are the council noise complaints we made still relevant? And if so, how do they affect the sale? As we haven't complained for well over a year now. How do they decide what to do? Because what if a lovely couple with children or something move in and end up being beaten up as we were!?
PROBLEM 2!
Myself and my partner are both living back home with our parents (as stated above), it isn't the nicest of enviroments! Our problem is that we are now desperate to move out but both have poor credit history now and don't know how on earth we are going to find someone to lease us a property!
We absoluely MUST get away from the area as in 8 weeks time we are starting our second cycle of IVF in London and it is so very stressful living in this horrible area. Our first cycle was private and cost quite a lot of money. This second cycle is our NHS cycle and we can't decline it or we will be taken off the list! So we can't postpone it. But its so crucial to get us away from this '24 hours a day' stress and anger trap. We are all in such a horrible mess.
Can we rent a house with poor credit history?? My partner is employed full time and i am self-employed at home.
PLEASE PLEASE PLEASE HELP!!!!!

Your situation sounds appalling. I can understand your fears of a family moving in and it happening to them, but I think your parents should sell the house and never look back. Don't tell prospective buyers as they'll run a mile.
You may want to contact citizens advice about this, See if they can help as your obviously too affraid to complain for fear of another incident.
The worst that could happen is they can't help you, but you never know.
Can you not stay living with your parents if they move?
Is there no council housing or housing association you can contact for a place to rent?
Granted it wouldn't be ideal but if you have a record of paying rent on time for a period then you shouldn't have any problems privately renting afterwards regardless of your credit history.
I hope everything works out for you. xSome times all you need to get along is nothing at all.0 -
Your poor family, what an awful situation
I think you would have to tell prospective buyers about the complaint. I believe that if you don't declare it and the new owners had a similar problem and then found out you had made this complaint and not said so on the forms, then your parents could possibly be sued. I believe that you are not allowed to withhold information that could either devalue the property or if the new owners had known about something then they would not have chosen to buy it. I hope someone can reply to you very soon and confirm if this is correct.
You say that the neighbours were reported to the council, just want to confirm, is it a council house with council tennants, or did you report them to Environmental Health due to the noise? I understand that you would not want to make any more complaints, and in your situation I wouldn't either, but if they are council tennants there is a lot more chance of something being done rather than if they are private tennants / owners.

Good luck with the IVF in a few weeks.0 -
I am almost certain your parents will have to declare any neighbour disputes as your asked when the sale is going through. If the buyer were to find out 6 months down the line your parents had failed to tell them, I think the buyer can take legal action against your parents.
As for renting it depends how bad your credit rating is. You may need a guarantor, if you don't have one you could look at a private LL renting on his own ie not through an agent, you may find these don't do credit checks and if they do they maybe more human than agents to deal with.
