    I thought if someone takes your photo for commercial use they have to have your permission in advance, unless you're a public figure in which case it's open season all year round.

    From what I've read so far, in the UK in a public place you can take photos of anyone you wish (with or without their permission) and you as the photographer own the copyright of the photos and can do what you wish with them (e.g. sell them, publish them etc). It's only other laws that may apply in conjunction with the photos such as libel, blackmail, indecency etc.

    The guy is a bit of a twit but it shows how bullying police can be when even they don't know the law.

    As an aside, I thought it was quite interesting to read that the police have no powers to even delete photos from your camera. Only a court can order that. And if they or anyone else does it constitutes assault. Seems excessive but it may prove useful to know those rights we have.

  • oh i know this is a vent board so here goes what on earth is your point they used a picture of you did they ???? its an area and your in it as joe blogs if you were in the buff i would understand but this is surly a moan about nothing unless you told every one else you were some where else etc get a life for god sake also its not a good one thats ssuming you do take a good picture

    I disagree. I hate having my picture taken and would not like to have it in a brochure like this. Also, having someone else make money off me without so much as a by your leave would really irk me. I think OP is quite justified.

    I also disagree, although its a million to one shot its possible the OP could be recognised by someone he didnt want to see him etc. And as was mentioned before what if that wasn't his wife he had been with?

    To be honest, I doubt that any sales will be made or broken on the fact that the OP's pic appears in this brochure - I'm surprised anyone has even seen it considering what a niche publication it must be.

    Whilst I also disagree with the nature of The Lone Ranger's post, I don't think a photographer could really be considered the guilty party if the OP was cheating - if you appear in public with someone you shouldn't, anyone could spot you and pass on the information, and you probably deserve to be rumbled! (NB - this is in no way intended to imply anything about the OP, purely hypothetical!)

    The photographer however would have been paid for the image.

    This is true, imagine the OP had been severally physically assaulted by her late husband. He sees her on the brochure, tracks her down and murders her.

    By all means this thread is jokey but this is way too serious, this is real life.
