Nationwide/Shoosmiths /KPR Court Proceedings : (

Hello MSE'ers

Just wanted to see if anyone has got any advice really about Nationwide? We have a DMP with payplan since July last year for £70+K which won't be paid off until 2028 :eek:


3 of our debts are with Nationwide. We have had loads of letters from KPR regarding these particualr debts and then it was Moorcroft who sent a payment booklet but we continued through Payplan and now we have had a really nasty letter from Shoosmiths about one of the debts saying they are not interested in instalments, money should be paid directly to them and that they are taking court proceedings. They have mentioned charging orders.

Ironically, we have just had our mortgage renewed on a 10 year deal with the Nationwide - no problem. If they are so worried about getting their money why did they agree to the new mortgage deal? :confused:

Anyway Shoosmiths were just as rude on the phone and Payplan have not got back to us so we are fretting a wee bit _pale_

What should we do? We can't afford to up our payments on the DMP atm, when our mortgage deal starts next month thats another £50pm to find as it is, if we did not have that deal it would have been £200pm as the fixed rate we have just come off was a great deal which sadly had now run out.

Just wondering what sort of court proceedings to expect? We have 2 teenage dependants and are anxious that our home should not be jepodised. Is the house at risk? There is no surplus equity because we have a secured loan on it which woudl swallw up the equity that exists.

Crystal ball and lotto numbers anyone?!

    Hi Coochycoo. I'm not sure of the answers but will bump your thread for others to see it. I would keep on trying to get hold of Payplan though, as they will be able to advise you what to do.

    You may have read my amblings about Nat West. Their solicitors rang us and threatened a charging order against our property regarding our overdraft, which at the time we were kicked out of the bank stood at £4.8k, then after they failed to tell us they were chraging interest against this, it went up to £5.5k. We told the solicitors we couldn't pay as we were on a DMP, and then ext thing was the blue court papers arrived. You don't actually have to go to court over this. We contacted CCCS who we have our DMP with and were advised to complete the forms and return them to the solicitor together with a SOA and a list of creditors and amounts owed. Then we received a CCJ accepting our payments. However just to let you know that if this is the route they decide to go down after reviewing your SOA and creditors, it is a legally binding agreement and if you find that you are able to increase your DMP further down the line, they will not be able to ask for more money, so effectively shooting themselves in the foot.
    I think solicitors acting for banks are rude in general, but I took no notice as they are not solicitors who call you just some jumped up junior office gofer!!! (as I pointed out)
    Incidentally we also have a mortgage with Nat West!
    Try contacting Payplan again and ask to speak to someone urgently on this, alternatively you could perhaps try contacting Nationwide to see if you can sort this out?
