Seller not being very helpful with my complaints

Hi,

I was wondering if anyone could offer some advice. I bought a pair of speakers from ebay before christmas, I paid £75 for them. I paid by echeque and which cleared on the 24th. The seller posted them on the 27th. The problems are they are more damaged than he has described, it is cosmetic damage but the problems are obvious, its not like he could have missed them!! They were also filthy, I know not a complaint on its own but it added to the dissapointment. They were also supposed to come with a pair of stands which have never arrived.

I emailed the seller on the 31st when they arrived, he didn't reply. I emailed again on the 4th and he claims he didn't get my message. I sent it again and he replied on the 5th but was not very helpful. He said that I should note that he paid twice as much for postage as I paid for it (I paid 9.99 and it actually cost him over £20), he also said what did I expect from a second hand item and that i should be happy I got a bargain. He then asked what I wanted him to do about it. Not really the apology I was after!!!!! I emailed back saying that I felt the price I paid was irrelevant as I was complaining about his lack of detail about the damage. I also said that the price he paid to deliver was not my fault, he stated it would be 9.99 not me. I also told him that the stands have not arrived. I asked him to contact royal mail to find out where the stands were and to get back to me so we can take it from there.

What do you think? I am pretty upset about all this as they were a christmas present and it has all gone wrong.

    You need to get to the point in your email. Tell him what you want.

    For examaple

    "I want to return for a full refund at your expense" or

    "Give me £10 back and I'll be happy enough"

    Etc. You decided what you want, of course. He might not agree, of course.

    Don't use feedback blackmail though.

    I have said to him that I wont leave feedback until the whole thing has been resolved, I hope that isn't bad? I just thought that it was better to tell him that I wouldn't complete the transaction until I was happy.
  • start a paypal dispute as item not as desrcibed, to get a refund. YOu will have to return the speakers, but only when paypal advise you to.

    How will Paypal decide this? In this circumstance 2nd hand with some damage described) OP might lose, so especially at this stage this is not a route I would advise. As previous poster said ask for what you wat and then decide how to proceed if he refuses.

    I agree with Hintza. Where there is a dispute over the actual condition of items sold as second hand a paypal decision could go either way, in fact this is one instance where the seller is often the victor in the dispute.

  • sorry to be negative but i dont think the OP is likely to win on the condition as these are used. condition is a common complaint with second hand items with buyer and seller disagreeing on what is reasonable wear. "used" is difficult to define.

    you should draw attention that part of the item was missing however (presumably as he was already smarting at the postage costs nad omitted these!)

    I would try and negotiate some form of compensation with the buyer first and only if this fails start a ' not as decsribed' which may be drawn out and not reach a satisfactory resolution.

    his postage : item cost arguement is entirely irrelevant so you are probably dealing with a ****head

    I wouldn't leave feedback at all. You KNOW he is going to neg no matter what you put.

    If he leaves feedback first, then okay but the likelihood of that happening is pretty slim.
  • Thank you for all your replies. The sellers description of the speakers was very detailed, however he has missed out other areas of damage, so I knew to expect certain faults but he has ommited other faults.

    Still no word from him. I would prefer to get some compensation back and keep the speakers, I cannot see the stands arriving to be honest.

    I will hold off leavincf feedback and see how it goes.
