MSE News: Misled or unfairly treated by car finance claims firm? Complain now

If you're unhappy with how a claims-management company or law firm has managed your car finance mis-selling case, or think it's treated you unfairly, you should challenge it by raising a formal complaint. The financial regulator has issued new guidance on how to do this, including a free template letter, after it found some firms causing "serious and unacceptable harm".

Read the news story and find out how to complain here:

As I was unsure if I have been misled and taking guidance from the website I raised a complaint form using the MSE template. However, I have not had any response from the company I raised and it has been over 2 months. Any guidance of what to do next?

I didn't realise MSC had a template form for complaining against claims companies.

Whilst finance companies have a good reason for not responding to the actual complaints, seeing as the scheme isn't open yet and it's on hold until November at the earliest, claims companies have no excuse for not responding to a complaint. You should go back to the claims company and check they have your complaint. If it's one that is regulated by the FCA, then you can go to the Financial Ombudsman Service as the claims company hasn't responded to your complaint within a reasonable time.

  • What if it is possibly fraudulent?

I kept getting emails from a firm called Courmacs Legal about the car finance redress scheme. I thought they were just junk so kept deleting them. Then I saw this video and I thought, maybe I should check this out.

I sent them an email saying I do not wish for them to act for me in any way for the car finance redress scheme, and to remove my details from their system. Thought I should, just in case.

I got an email back from them saying I signed an agreement, instructing them to act for me, and they would take a 30% cut of whatever I was compensated. If I no longer wanted them to do this, then as the 14 day cooling off period had passed then they would charge me for any work already undertaken.

Also on the email was a link to a form I apparently signed. The form had a surname on it which I haven’t used since 2018 when I divorced, and an address I haven’t lived at since 2017. There was a signature on it which is not mine, and I apparently completed and signed this form on 18th September 2024. Why would I complete a form using details which I haven’t used in a very long time?

I have raised a complaint with Courmacs Legal as I strongly believe this to be fraud and carried out without my knowledge. But I’m worried that they’ll still say I’m bound by this “agreement” regardless.
