can i still get student loan during bankruptcy?

    I know these messages were sent ages ago but I ahve a question that I hope someone can answer. I am about to go bankcrupt in two weeks, I will recive my last payment of student loan and bursary payment in april/may what i want to know is will this payment have to be stopped or can i still have it? secondly do i have to declare my student loans because it is not included in the bankcrupcy, and finally will this income be put towards paying back my debts? I would appreciate it if someone could answer these questions
    Yes you can still have it. It's your income and the OR will not expect you to give up any of your loan/bursary towards your bankruptcy. You will still have to declare it as obviously he/she will seee it going into your bank account every month.
    My student loan will be paid mid April, I am planning to go BR in May so that our tenancy is renewed for another year and we have that security. The money will already be paid out by then, I took out the student loan to pay for my wedding so I'll guess I'll have to wait and see what the OR makes of that one..
    If I was you I'd keep schtum about your reasons for taking out the student loan, but seeing as it's not written off in BR, your OR in all likelyhood won't ask about it. He'll just assume as a student you needed it as income to fund your studies.

  • i too will be applying for a student loan next year, one thing i felt i need to add (from advice i have been given on here) is that you should not buy something like a car or bonds etc with the money, anything that can basically be turned into an asset and they will then have an interest in it:(

    allot of us will us it to live off anyway but its good to know we can also put some aside for emergencys etc :)

    Can he still get it?

    Music Monkey, that is a commercial enterprise and the advice on the board is not always sound for so called experts, especially ones who will charge you to 'help' with the BR paperwork. I would not reccomend them and wouldn't touch them with a barge pole.

    This is also a very old thread, started 3 nearly 4 years ago,on a question that has been asked a 100 times since and the correct info has always been given on the new threads.
