PCN entered the car park twice to turn car around but did not park there

Hi,

I’m looking for some advice regarding a Penalty Charge Notice (PCN) I recently received, and would really appreciate any help you can offer.

What I assume has happened here is that there is limited space to turn the car around the area where the car is parked, hence to turn the car around they have went into the area where the camera is pointing at. In doing so it seems that a camera has captured the car entering at two seperate times.

According to the PCN the car entered at 10:31:34 and left the next day at 07:44:44, staying in the car park a total of 21 hours and 13 minutes.

I spoke to the individuals at Holiday Inn and they told me that they cannot resolve the issue because I am not a guest.

I was wondering if there are any other suggestions I should include in my appeal or any thing else I should know?

    Others will be along to explaining more detail but I can't see any mention of PoFA on that letter which means whatever you do don't give away who was driving.

    You could as the owner tell them to check their ANPR logs as they have clearly missed the exit event for the first instance and the entry event for the second.

    I think if you read that notice to keeper again you will not find the word "penalty" anywhere, why have you used it?
    You are lucky providing that you do not let the idiots know who was driving, you have a golden ticket from Parking Eye.
    You have been caught by ANPR on what is known as a double dip, by a fallible system that isn't fit for purpose.
    That NTK is not compliant as it does not mention the Protection of Freedoms Act 2012 and it was issued too late from the event to hold the keeper liable.
    So long as they don't know who was driving they cannot hold the keeper liable, @GrumpyDil is wrong to quote "owner" it's all about the keeper the word owner does not appear on any paperwork, I could own the car as far as they know!
    Do not use the word I e.g. I was or I did in any communication or admit to being driver in any way.
    Read the newbies thread on page one, and send the blue appeal to the dimwits at PE, this can later be killed off at POPLA but don't send off anything to them without getting help from here.

    They are just fishing for the driver's name - of course you ignore and wait for your rejection and POPLA code.

    Did you get a rejection and a PoPLA code? If so, did you appeal? If so, what was the result.

    What happened when you complained to the landowner/hotel manager/IHG CEO and your MP? That is Plan A and it is never too late to carry it out.

    Thank you for the quick reply. After submitting the original appeal this was attached on the response email.



    Since then no further response apart from the letter by post, no rejection email or a PoPLA code. Is this suppose to be given by email? It has been over a month since the response above.

    Check your spam folder for any email from Parking Eye 

    If you definitely had nothing since that phishing expedition reply, put a complaint in to Parking Eye using the complaint link on the BPA AOS members list, stating that you have never received a cancellation or a rejection containing the Popla code 

    However, that DCBL letter is for 18 th January 2024, not this case which occurred in September 
  • Ok a complaint will be filed. Thank you for your advice. 

    With the DCBL letter I noticed that the January date as well so I am confused what that is in relation to as well.
