Help please - Defence against CCJ filed by BW Legal and Parking Property Management Ltd

Hi All,
I would be very grateful if I could get some help as I have been trying to understand for days but cannot get my head around all the information available on here. 

I first received a Claim Form from the Civil National Business Centre in July '24 for the amount of £245 for an unpaid parking charge. The claim is that the drivers breach was 'unauthorized parking'. The total amount is made up of the amount claimed (£160 - 100 for the fine then another 60 for 'recovery costs'), court fee (£35) and legal rep costs (£50). There was no unauthorised parking as I had parked in bays marked specifically for patients of the GP surgery that I had just joined that same morning. I also paid the fee required by the surgery (once the parking form is filled out on their ipad) and I have a letter of confirmation that I was there for an appointment.

I have already completed the N180 form, where my defence was acknowledged. I then had a mediation meeting at the end of September where I confirmed that I was not willing to make any payment toward this claim. 

I am not sure if it is now too late in the day to submit a defence pack? I have not received any letters or notifications that a face to face hearing has yet been set, do I still have time to submit a defence? I have started drafting it using the defence template on the discussion boards but also am not sure if I've done this right!

Any and all advice would be greatly appreciated

    Hello and welcome.

    The simple fact that you were sent a Directions Questionnaire to complete confirms that you have already filed a defence.

    Did you perhaps write anything in the Defence box on the N9B form?

    Thanks so much for responding, I have only completed the N180 form, I have the N9B form here (which I only just realised I had) but haven't completed or submitted this. There's no date on it so I can't tell when exactly this was received.

    Hmmm.... that can't be right.

    Something happened in the July/August timeframe that led the CNBC to believe that a Defence was filed.

    Can you please login to MCOL and show us your Claim History?
  • I just checked in my MCOL account and yes I did in fact submit the N9B form (apologies) mid July. It looked different to the physical copy I was sent that I have here, as there weren't any sections which asked for employment/ bank accounts/ savings. I'm guessing this means I can no longer use and submit the full defence that the forum has provided. Wish I had checked online when I had received the initial Claim Form!

    So I guess you have no record of what Defence you actually filed?
    I.e. what you wrote in the Defence box on the N9B form.

    You need to phone the CNBC - number on your Claim Form - on Monday morning and ask them to email a copy of your filed Defence to you.
