Laws wrt advertising on Site

Curry's has made me a bit angry!

I ordered a laptop from their site (advertised as a boxing day special). However, I just got a call from them, It seems they made an error on their site. It said their laptop would come with a 7 series nvidea video card - which is what i was wanting so i ordered it.

After taking the money off my credit card i now get a call saying that they made a mistake and it does not come with the video card as advertised, its an integrated one, so when its delivered i can
(a) return it and get a refund
(b) accept the laptop and if i call a nunmber they'll give me a 30 pound voucher for my troubles

Considering its not the laptop I thought i was ordering, I'm obviously going to have to return it (when they deliver it in a week or so).

But its highly annoying since it really wastes my time having to return it and having to now surf around for another laptop :/...I think they should have at least compensated me for the waste of time if i choose not to take the laptop.

Are there any laws regarding what is advertised on a website and purchased must be delivered?

    Yes you can make a complaint to the ASA (advertising standards agency) depending where the AD was. However they have already offered a good will gesture of £30 - !!!! really you could get more if you pushed.

    There have loads of T&C's on their site basically saying errors are excluded. You could reject the laptop when it arrives. Just don't sign for it/accept it and the courier will take it back - no hassle or fuss on your part. Its a wonder why they cant stop the delivery?

    You can argue you have entered into a contract for said goods and they are of different spec, and the money has been taken, but it's a lot of hassle, few have tried in the past and won, but is it really worth the hassle?

    Are you aware that the nVidia 7xxx and 8xxx cards are integrated?

    If I were you I'd wait until it arrives before complaining - Currys et al staff are hardly the most technically proficient.

    Under the DSR, you have 14 days to return it.

    I'm sure during the checkout process you'll have clicked a box confirming you've read and accepted the T&Cs. One of them will be that no contract is made until the product is delivered. All the big firms are tight as a drum on the legals after the great Argos TV disaster.
  • Thanks for the replies...I think you may be right. They're quite airtight on their T&C's...i did complain, but the best i could get out of them was that they'd accept it returned...when it arrived, it got there with the correct video card stangely enough, even though they insisted noone gets the right card...aparently they have 5 different versions of the same laptop, which they market under 1 code on their site...which one you get could be any of the 5...very strange.

    So what video chipset DOES it have?

    ALL laptop "graphics cards" are integrated. built onto the motherboard, non-upgradeable.

    Give us a link to the laptop or tell us the model and we'll take a look.

    edit: ignore me, I didn't realised it'd been resolved. That big block of text in your last post was unreadable :)
