Contentious probate

If someone who was formerly illegilble for benefits is now in the limbo land of not knowing what they own due to having a will challenged, are they able to claim benfits like jobseekers allowance?

     Have you received your inheritance or is it being held by a solicitor

    I think you need to provide a lot more detail. On the face of it if you weren’t entitled to a benefit before the inheritance, then you are still not entitled to it unless something else has changed.

    Until funds are released by the executors they are not part of the benefit claimants capital.  They can continue to claim.  I'm assuming the OP meant eligible for benefits.

    Well, being pedantic, Jobseekers Allowance (now known as 'new-style Job Seekers Allowance' ) is not means tested, althoughany pension income over a certain amount will be deducted £1 for £1. Eligibility depends on the applicants National Insurance record over the last few years, so a persons potential inheritance or otherwise is neither here nor there. 

    If they are not eligible for JSA, then the most likely benefit to claim would be Universal Credit. This is indeed means tested, but as TELLIT01 says, if any potential future inheritance is yet to be distributed and is being contested then I don't believe it would be taken into consideration. 

    Both benefits would require the claimant to demonstrate that they are actively looking for work unless there are other mitigating circumstances (e.g. looking after young children)
