UKPC parking invoice, all corrospondace igonored and now issued a CCJ. lost and in need of help

But only pay it IF you can do it before the time limit set by the judge in the judgment. Otherwise the CCJ stays on your file for six years.croydesurf said:@B789 thats really sound advice, I think that will likely drive my decision. if the CCBC say the claim was sent to the correct address, we will most likely pay the CCJ as the cost of setting aside the CCJ is of the same value. there is no guarantee we will win and the stress involved in appealing at court may not be worth the saving. ill find out when the claim was issued too.
I think the thing i hate the most about all this is that we didnt do anything wrong, ill be sure to write to the MP about my experience regardless of the outcome so that he knows that people are having sleepless nights over unfair parking fines.
ETA - reading again your OP, it would seem that judgment day (to coin a phrase) was 10 July, what was the date set by the judge for payment?1 -
@croydesurf, did you speak with the CCBC? As @Le_Kirk above, I have just read back through the thread and, if as you mention, the CCJ was ordered on 10th July, it will now be on your record for 6 years unless you manage to get it set aside.
If you have known about this since at least mid-July, you are also going to have to convince a judge that you acted promptly as soon as you found out about the CCJ. You say you received the judgment order from the court, so they have your address.
If you apply for a set aside, you will have to convince the court that you did not receive the claim form. There is no way to prove you did or you didn't as they are not sent recorded or even with proof of posting. You could try and ask the CCBC for strict proof of posting but I don't think you'd get far with that. You could show previous communication with the debt collectors but they are not really a party to the claim. Was there ever any communication from DCB Legal? They would have sent a LoC before the claim was issued.2
