covenant

I have a covenant on my house saying i cant erect a garage. The house has a garage that was build by the developers at the same time as the house. I extended the garage

Has this broken the covenant.

  • What does the covenant actually say? "You cannot erect a garage" or "You cannot erect any structures such as a garage"?

    It's likely to depend on the exact wording of the covenant.
    Whether or not anybody will do anything about it is another matter entirely.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.
  • Unless the party with the benefit of the covenant is still around and cares enough to take action to enforce it against you, nothing will happen either way. Except that possibly when you sell the buyer's solicitor might notice and ask you to pay for a pointless indemnity policy (pointless, but pretty cheap - maybe a few tens of pounds?)....
