Hello, earlier in the year I made the mistake of doing 36 on 30 duel carageway thinking it was 40
i was fined 3pts and £100, I paid online and posted the form off with my licence detail. 4 months after the speeding I have received an email saying I’m being refunded £100 - initially I did think it was a scam but as some one with a lot of health issue and gets anxiety now easily I googled it and came to the conclusion it was really so I emailed both the police camera team where the mistake took place and the camera office that issued the refund asking what had gone wrong. They asked for my details which I provided and they said they never received my letter with my licence details which was part of the conditional offer and it was standard to send me court papers (i have yet to receive them). I have emailed back saying this is a misunderstanding and that why has no one contacted me as I did as asked so could they please help. I haven’t heard back yet.

I am deeply worried about this as I am very unwell after getting sick with bartonella+lymes then much worse at the beginning of the pandemic with covid. I am not fragile and of little wealth so can not mentally or financially deal with any serious court outing. Is there anything I can do to do stop this and if not what is the expected out come and can I get any leniency?
Thank you for anyone that takes the time to read I’m sorry it’s long.
Regards
Carl

If your case is dealt with in court (under the "Single Justice" procedure) you can respond to the court notice by pleading guilty, explaining the circumstances, and ask to be sentenced at the Fixed Penalty level. Magistrates have guidance which suggests they might do this in your circumstances:

"Where a penalty notice could not be offered or taken up for reasons unconnected with the offence itself, such as administrative difficulties outside the control of the offender, the starting point should be a fine equivalent to the amount of the penalty and no order of costs should be imposed. The offender should not be disadvantaged by the unavailability of the penalty notice in these circumstances."

It's only been 6 days since the previous post, and 2 of those days were a weekend. The wheels of "justice" don't turn that quickly. :)
