Group Nexus PCN

Hi, my sister got a PCN letter for not parking wholly in a bay. She argued it was likely another car had parked awkwardly and so she parked in between a line- however the picture shows her car alone so the other cars may have driven off. The PCN comes from Group Nexus which I haven’t heard too much about- I’ll give the thread a search but the appeals process says to simply email them to appeal

    Oh no she hasn’t appealed yet, I’ll be doing that. You and the forum have helped me in the past, it’s usually been an overstay charge but not heard of getting one for not parking properly! Will read the thread and other threads in the mean time whilst I use the template! Thanks

    Only in  her name, not your name (even 'on behalf of ... ').

    Can I use this that I have found re group nexus? 

    No driver details will be given. Please do NOT try the usual Group Nexus Trick of asking for driver details in order to get around the fact your NTK does not comply with POFA. As there is no keeper liability then liability cannot flow from the driver to the keeper and thus is an auto win @ POPLA. Please therefore cancel the notice or issue a POPLA code where you will auto withdraw

    Good research. If you're still within the Group Nexus 28-day appeal window, try that. @Grizebeck, a regular, knowledgeable poster here reckons it works. Let us know how it goes.

    Hi all,

    they rejected the appeal as expected. 

    I looked through the threads but can’t find anything relevant. How can I argue that it doesn’t take into account other drivers parking that caused her to park like this? Also, the pcn doesn’t show the time of the contravention. Could argue that it was busy and this was the only viable option at the time.

    None of that wins at POPLA.

    But your sister will never pay as long as she doesn't ignore a court claim next year and doesn't move house without telling them her new address.  We assume this was in England?

    How did the escalated complaint to the landowner, hospital or retailer go?

    Yep in England and she complained to the retail park and got nowhere saying there’s nothing they can do.

    what kind of points can I raise at POPLA for this?
