    Haven't had a response since yesterday, they were quick to respond to my first couple of emails and responded within 30 mins

    Why isn't the registered keeper, who has protections in law that the driver does not, dealing with this? What will you and the keeper do if VCS decide to go ahead with the court claim against the keeper because the keeper hasn't told VCS they are seeking debt advice and want it put on hold.

    Why do you want to throw away defence points that the keeper could otherwise use? Is that what the keeper wants?

    If you were driving but THEY are getting the court claim soon, the keeper should transfer liability now.

    You will have to wait to see what VCS do next.

    They could accept that you were the driver and "should" then send you a NTD, resetting the clock so you can then appeal.
    They might decide to continue with the claim against the keeper. You can help them defend it but it must all be done in their name, and they will have to appear in court even if you or someone else acts as a Lay Representative for them.
    They might decide to issue a LBC against you, or they might decide to issue a claim against you. They shouldn't do either, but if they do then you should complain to them, the IPC, and the SRA.

    If the keeper truly doesn't want to deal with this, then they should name the driver right now to transfer liability. This must be done before a court claim is issued.

    Defending a claim will in 99% of cases cost less than the original amount claimed even if the defendant loses.

    This does not affect Plan A.
