No reply to CPA 31.14 Cabot

Hi all,

I received a county court claim from cabot in April last year. I requested details as per CPA 31.14 and had no reply which I entered into my defence.

Since then I have heard nothing.

I have a default on my credit report for this since 2020 I now want to start to get mortgage ready and want to make a full and final settlement, what percentage offer should I go in at?

    Have you started by asking a mortgage broker how much of a problem this is?

    Yes, they said that the defaults (3 in total) aren't an issue as long as they are over 2 years and show as partially or fully settled with a 0 balance. Leaving a gap of 12 months from settlement before applying for a mortgage.

    That's a difficult question. What you don't want is a ccj on file and if you stir things up now, that will alert them to the fact that this claim has stalled. They may move it to a hearing, that you're not guaranteed to win.

    Of course if you get a ccj, it doesn't get recorded if you pay it off in full within a month.

    I suspect one default isn't going to be a huge problem if you check with your broker.

    Thanks very much. The broker said that I do need to make sure they are settled in some way through a full settlement or full and final (partial) so do I contact Cabot again and try to settle with them directly?
