Online purchase returned, PayPal refusing to refund

Purchased a joystick, RRP £228, online. Paid next day delivery. Received next day, but was a set of headphones RRP £80. Contacted retailer immediately who sent me a returns label.

Returned via parcel shop 24/1 as per retailers instructions. Collected 26/1 by courier , tracking still shows as collected by courier and in its way to retailer.

I have contacted courier who advised it is up to the retailer to log receipt of item and that the retailer would need to follow up.

Retailer refused refund, saying they’ve not yet received it. It’s been 5 weeks now since I returned it. 

Logged PayPal dispute as, however they have closed the dispute with the reason of: Invalid tracking due to retailer not receiving item.

im struggling to see what more I can do. Courier will not deal with me as I did not arrange the return. Retailer will not refund as they say they’ve not yet received it. PayPal will not refund as they’re saying retailer has not received it!

Surely, I’ve fulfilled by obligation by returning it using the retailers returns process. So, I should get a refund, and the retailer should claim from the courier?

The most frustrating part of all of this is that I didn’t even receive what I paid for in the first place!

    So I assume from that (??) that the retailer paid.

    If so, then providing the OP has proof of dispatch then the retailer is obliged to refund. If it has been lost or is stuck in the courier's system than that is for the retailer to sort out as they have the contract with the courier.

    OP, I would send a "letter before action" to the retailer giving them a short but reasonable period to refund you in full failing which you will take action in the county court.

    It is not Pay Pal's problem unless they offer a specific benefit that covers this sort of issue and you have fully complied with their terms and conditions.
