Debt Free

Hi I wrote my CCA request and currently 2 debts are being held as unenforceable. 2 Tesco credit agreements provided but PRA won’t budge on settlement figures. Today pRA sent me a generic credit agreement as proof of my debt stating it is for my account . Is this acceptable? Enforceable debt ? Any help appreciated thanks

  • dont know what they sent you but when i requested a CCA they sent me a load of statements. I wrote back saying that this wasnt what i requested, i will wait for a CCA. They wrote back saying that they were waiting for the paperwork from Bcard. lol, im still waiting 5 years later, not paid them a thing. Good luck.

    It has to be a proper reconstruction of the agreement that you would have signed, including your name and address as they were at the time. It does not need your signature.

    Without seeing it we couldn't even offer an opinion as to whether it would comply with s77-9 anyway.

    If they want to test this they would have to start a court claim.


  • Thanks both .they sent statements before but now just a generic t & c s no signature etc . I’ll email them back and hopefully that’ll end there 
  • Hi PRA have provided this unsigned/unaddressed copy that’s could belong to my great aunt Bertha yet saying the debts enforceable how ?? Any help would be appreciated

    Refer them to CONC13 if you like.

    Or just ignore.

    If they feel that they are right they can ask a court to rule on it.

    I doubt it will come to that

  • Hi it’s PRA again !! Wrote to them sec 77/79 thanks to member advice. Got 2 debts statute barred but on the others they are being so harsh . Will not negotiate. Even checking if I’ve got a mortgage is this ok to do ? Any help would be appreciated especially as it’s Mental Health week ! Really struggling with this currently. Thanks

    Do you mean they are asking if you have a mortgage? You do not have to answer them.

    Have you sent them a 'Debt and Mental Health Evidence Form (DMHEF)?

    They are persistent, I have an old Barclaycard debt that they can't provide the CCA for but they phone me every two days and write every couple of weeks explaining how they can help me.
