    Please now show us your para 3 and nothing else.

    You don't need to know much about the case, just some facts about the car park and what you do and don't know about the event.

    The particulars of claim should be in the claim form but they are likely to be generic, i.e. broke the terms and conditions, so just use a generic defence and, at witness statement stage later in the process by which time your data should come from your SAR, you can flesh it out with evidence.

    Thanks, here is a first draft.

    3. The defendant entered the McDonald’s car park on Barlow Moor Road, Manchester on 28/09/2018 to meet a friend whose partner had terminal cancer and was staying in the nearby Spire hospital on the same road.  The defendant did not notice any obvious signs that displayed any parking controls upon entering the car park, or when entering the MacDonalds restaurant.  The defendant then proceeded to spend time with his friend, eating and then talking for longer than would normally be spent in such an establishment.  At no time was the defendant aware that this could be breaking any rules relating to the duration of the stay, nor was his focus on this in those circumstances.  Following the time spent with his friend, then defendant left and again noticed no obvious signs that informed that any contract had been entered into regarding the length of stay parking in the said car park.  The client therefore denies any contracts was entered into, and rejects the unfair charge issued by the claimant.

    Sorry I only just spotted this, does my reply veer too much into witness statement territory then?

    Remove this as it doesn't help:

    "nor was his focus on this in those circumstances."

    That'll do, as long as you added 'and driver' to para 2 of the template plus your claim number carefully typed top right, then the claimant's full company name (which is not DCBLegal...it's the PPC) then add your name, a scan of your signature (on a white piece of paper then photographed) and date.  

    Job done. Get it emailed as a PDF and copy in the email I said to copy in!

    Ah tbh I say guys to ladies and gents alike  :)

    Yes I've received the acknowledgment.

    I'll go and read the following steps to make sure I am much more prepared for what's to come!  Am well aware that I'm quite lucky that my mismanagement of the process didn't end in a default and loss to these shysters.

    Just to double check - CCBCAQ@Justice.gov.uk is the correct adress ofr CCBCAQ isn't it?  I have the acknowledgment but just wanted to double check as it's unclear on previous cases.

    Also, do you think now is a good time to file the SARS request so that I have all info for this potentially going to court?
