Changing Power of Attorney on will

Hi

We need to change the Power of Attorney on my mums will. As there has been a family arguement and my sister does not want to be involved with the will or any arrangements. It was done via a solicitor. Any idea if they will charge to change it? Or can the forms be submitted again to change the details.  Thanks

  • Power of Attorney ceases on death so it won't make any difference.

    Do you mean Executor of the will.. That is a different matter.

  • Yes a Solicitors will charge for their time to change executors on a will.

    You will need to get your mother to sign the amended will and to have the signing witnessed by two independent witnesses.
    the POA process is completely different.
    Doe your mother still have mental capacity to authorise these changes ?

    Nothing the matter with your sister abdicating responsibilities to someone more willing.  

    A new POA can be drawn up or if that's not possible she can be the official POA and refer people to someone else.

    Likewise with a will - she can withdraw in favour of someone else when the time comes rather than get a solicitor involved at this point.

    new POA would be about £82 done online.  Not sure the costs for the will but I'm sure someone else will let us know.  Or start afresh in free will month (Nov?)

    yes, she is stll able to agree to changes
  • If your sister does not want to be an executor then she can simply revoke her powers when the time comes. Unless your mother wants to appoint a replacement then she can leave things as they are.
