Hi,
Can my wife pass on the £1260 marriage tax allowance to myself?
I think I need to be a basic rate tax payer?

My wife only earns £3-5k annually, but I earn just under £48k basic (following salary sacrifice into my pension) + bonuses (I am salary sacrificing my bonus payments into my pension) + benfits in kind of about £7k (I am also contributing into a personal pension to keep me below the 40% tax threshold).

So with all of my pension contributions keeping me within the 40% tax threshold, can my wife pass on the £1260 marriage tax allowance?
If claiming for past years would I have to check my P60 earnings level, to make sure it was below the 40% tax threshold?

You have to be a basic rate taxpayer for each year that the marriage allowance transfer is made, so you need to check the P60s.

Your P60's might in fact show earnings above the standard higher rate threshold but if you personally make relief at source contributions then your basic rate band will be increased to reflect the gross contribution (assuming you've told HMRC about these contributions).
