UKPC DBC Legal PCN Claim

Hi,

Hoping for a little additional guidance, as i'm starting to feel a little overwhelmed by all the information on here.

I recently received a court judgement (I believe that's what it's called) from The County Court Business Centre (CCBC) - dated 04 Jul 2022. The 'offence' is from July last year.
I ignored all letters from both UKPC and the following Debt collectors letters as I it all looked like a scam. (even the CCBC letter looks off to me (low resolution imagery) - though a phone call confirmed it's legit) - sinking feeling!

Particulars of Claim
1. The Defendant(D) is indebted to the Claimant (C) for a Parking Charge(s) issued to vehicle ******* at McDonalds Leeds Wakefield Road 1595 Dewsbury Road Roundabout
morley, LS27 8DG
2. The PCN details are
09/07/2021 **************
3. The PCN(s) was issued on private land owned or managed by C. The vehicle was parked in breach of the Terms on Cs signs (the Contract), thus incurring the PCN(s).
4. The driver agreed to pay within 28 days but did not. D is liable as the driver or keeper. Despite requests, the
PC(s) is outstanding. The Contract entitles C to damages.
AND THE CLAIMANT CLAIMS
1. £170 being the total of the PCN(s) and damages.
2. Interest at a rate of 8% per annum pursuant to s.69 of the County Courts Act 1984 from the date hereof at a daily rate
of £0.02 until judgment or sooner payment.
3. Costs and court fees.

After reading the '**NEWBIES!! PRIVATE PARKING TICKET?' post I completed the following steps:

1. Submitted the 'Acknowledgement of service' via the moneyclaim website. (admittedly did this after day 3 though blind panic)
2. Submitted and received the SAR request info from UKPC
3. Copied the defence template from here - is there anything in there that needs editing other that 1 and 2? (i've read through it but just wanted to confirm)
4. Next step is to complete my defence statement (number 3 on defence)
5. Once step 4 is complete i'll follow the steps lined out in 'Submitting your defence" set out by KeithP.

That's it so far, but am starting to get confused about the 'Set Aside', or is that the same as 'Acknowledgment Of Service'? or if I need it at all?

Any help or advice greatly appreciated.

Did you receive a court judgment or a court claim form (N1)?  If it is a N1 claim form and, from reading the steps 1-5 that is what you have, then don't bother about the set-aside as that is for when people have received an actual CCJ rather than a claim form.  If, however, you have received a CCJ then you need to read the set-aside thread.

What's the 'date of issue' of the claim and what date does MCOL say your AOS was received?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ok - thanks - you lost two days by doing the MCOL earlier than day 5. But no harm done!

With a Claim Issue Date of 4th July, and having filed an Acknowledgment of Service already (but after just 3 days) you have until 4pm on 4th August to file your Defence.

Plenty of time to produce a Defence, but please don't leave it to the last minute.

To find our Template Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
Don't miss the deadline for filing a Defence.

Do not try to 'Start Defence' via the MoneyClaimOnline website. Leave that alone!  Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'. Defence and the subsequent N180 form (see NEWBIES thread) is done by email.

Thank you so much for this - really appreciate the help and deadline info - clarifies what I had noted down too so all good.
Is it ok to share my draft defence on here once written for feedback?

Yes, that is fine but only paragraphs 2 & 3 (or any additional ones that you need to add).  Once it has been critiqued, you can add in the rest of the template before sending it by e-mail to CCBC.
