TERMS AND CONDITIONS

 

1. By entering the Big Coach prize draw (the "Prize Draw”) you agree to these terms and conditions (the “Rules”).
2. If you are based in the United Kingdom; the promoter of this Prize Draw is H&M Hennes & Mauritz UK Limited (company number 01413450) whose registered office is at 1st Floor, UK House, 164-182 Oxford Street, London, W1D 1NN (“H&M UK”).
3. If you are based in Ireland; the promoter of this Prize Draw is H&M Hennes & Mauritz (Ireland) Limited (company number 396507) whose registered office is at 25/28 North Wall Quay, Dublin 1, Dublin (“H&M Ireland” together with H&M UK, “H&M”).

 

OPENING AND CLOSING DATE

 

1. The Prize Draw opens at 00:00 07.07.2022 (the "Opening Date”) and closes at 23:59 31.07.22 (the “Closing Date”). Entries received after this time will not be accepted or considered.
2. If for any reason a technical interruption, fault or site failure occurs when submitting your entry, H&M does not take any responsibility for incomplete entries and any incomplete entries will not be considered valid for entry into the Prize Draw. H&M accepts no responsibility for any entries which are not completed for any reason.

 

 HOW TO ENTER

 

1. To enter the Prize Draw:
   • Answer the question which can be found https://social.hm.com/en_GB/ukfestival or https://social.hm.com/en_IE/iefestival and complete the online entry form.
   • You must be a registered H&M Member, with a valid Membership account number.
   • You must be a resident of the United Kingdom and/or Ireland and be aged 16 or over if you are a resident of the United Kingdom; and aged 18 or over if you are a resident of Ireland. This excludes, residents of Northern Ireland, employees of H&M, their families, agents or any third party associated with administration of the Prize Draw who may not enter.
   • Only one entry per person is permitted.

 

1. H&M reserves the right to verify the eligibility of all entrants. H&M also reserves the right to disqualify and remove any entries based on suspicion of infringement of any third-party rights or if H&M has reasonable grounds to believe the entrant has breached any of the Rules.
2. No purchase necessary and there is no charge to submit your entry.

 

SELECTING THE WINNER

 

1. The winner(s) will be chosen by random draw supervised by an independent person within 48 hours of the Closing Date. The decision will be final. H&M will send the surname and county of the winners to anyone who writes within one month after the Closing Date of the Prize Draw requesting such information and who encloses a self-addressed envelope to the address set out in condition 2 or 3. If you object to any or all of your surname, county and winning entry being published or made available, please contact H&M. In such circumstances, H&M must still provide the information and winning entry to the Advertising Standards Authority on request.
2. The winner(s) will be notified [via the email account used to enter the Prize Draw within 3 after the Closing Date. If a winner does not respond to H&M within 24 hours of such notification the prize will be forfeited, and H&M will be entitled to select an alternative winner in accordance with the process described above.  If such alternative winner fails to respond the prize will be forfeited and H&M shall select a further alternate winner.  This process shall continue until an eligible winner has been notified and has responded.  Failure to respond or failure to meet the eligibility requirements of these Rules may result in the prize being forfeited.  Return of any prize notification as undeliverable, failure to claim the prize within this time or failure to submit additional information may result in disqualification and selection of an alternate winner as set out above.
3. No entrant shall be classed as a winner entitled to receive the prize unless and until their eligibility has been verified and H&M have confirmed that such verification has been completed.

 

THE PRIZE

 

1. 5 winner(s) will receive 4 UK festival tickets
2. The prize will be delivered to the UK or Irish address provided by the winner(s) when entering the Prize Draw. These details cannot be amended, varied or postponed.
3. The prize is not transferable or exchangeable and cannot be redeemed for cash. For the avoidance of doubt, the prize cannot be returned nor exchanged in any of H&M’s stores or online. The prize may not be claimed by a third party on your behalf.
4. H&M reserves the right to substitute the prize for an alternative of equal or greater value if the original prize becomes unavailable for any reason.
5. The prize is awarded at H&M’s discretion and no prize will be awarded as a result of improper actions by or on behalf of any entrant. H&M, acting reasonably, reserves the right not to select a winner.
6. Save for the initial costs of delivering the prize to an address in the UK or Ireland, H&M cannot be held responsible for any costs associated with winning the prize unless expressly stated in these Rules. If costs such as taxes, travelling or loss of income would arise as a result of winning the Prize Draw, they shall be covered by you.

 

 

GENERAL

 

1. Personal data supplied during the course of this Prize Draw will only be processed as set out in H&M’s Privacy Notice, as set out at Appendix 1 to these Rules, and passed on to third party suppliers only insofar as required for fulfilment / delivery / arrangement of the prize. We will not share your information with third parties for marketing purposes.
2. H&M may, acting reasonably and at its sole discretion, apply, interpret, terminate, alter, limit, suspend or modify the Rules and/or suspend or cancel the Prize Draw at any time, without notice. Any changes will be posted either within these terms and conditions or on the H&M website. The most recent terms and conditions will always be posted on the H&M website.
3. Insofar as permitted by law, H&M, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up or using the Prize except where it is caused by the negligence of H&M, its agents or distributors or that of their employees. Your statutory rights are not affected. 
4. Winner(s) may be required to participate in publicity related to the Prize Draw which may include the publication of their name and photograph in any media and their name being used on a list of winners.
5. H&M accepts no liability for any loss, damages or disappointment arising from entering the Competition or in any other way relating to the Competition, except for any liability which cannot be excluded by law.
6. For UK residents: the Prize Draw will be governed by English law and entrants to the prize draw submit to the jurisdiction of the English courts.
7. For Irish residents: the Prize Draw will be governed by Irish law and entrants to the prize draw submit to the jurisdiction of the Irish courts.

This privacy notice provides information on how H&M Hennes & Mauritz UK Limited (with respect to UK resident entries); and H&M Hennes & Mauritz (Ireland) Limited (with respect to Irish resident entries) collect and process your personal data when you enter this Prize Draw.

• Selecting and where applicable publishing details of the winner, for e.g. in our Fashion News or in accordance with Condition 9 of the Rules
• Notifying you if you are selected as a winner
• Sharing notifications relating to the Prize Draw such as any updates or changes to the Rules
• fulfilment / delivery / arrangement of the prize
• Opting you in to receive H&M Fashion News where you have consented to this

We may share your personal data with third party suppliers but only insofar as required for fulfilment / delivery / arrangement of the prize. We will not share your information with third parties for marketing purposes.
