National Insurance credit rejected due to child benefit in husband name

Hello

We (me and my wife) have been receiving child benefit since year 2007 when our child was born. 
We applied child benefit under my (husband) name as the benefit ask us to put only one parent name in the application in year 2007.

Since then, I start working and paying NI from my work and my wife is staying home taking care of our son. 

I later came to know that, mum who is looking after child and not working will have NI credited till child is under 12. 
My wife applied to Home Responsibilities protection (HRP) and Credits for parents and carers (CPC) for NI credit for her.

Few days later, we received later that NI credit is rejected due to my wife is not receiving child benefit. 

We are living together since marriage as a single family. Benefit office just mentioned my name in child benefit but is credited to our joint bank a/c.

I'm not sure why they have rejected my wife's application. 
The HM and Custom office asked to contact them within 30 days if we do not agree with them but did not mentioned any contact details. 

I would appreciate if any one can provide any guidance on this and not sure if my wife is eligible to get NI credit for looking after a child for 12 years ?

    What year did you start working?
    As far as I can see the HRP would only apply up to 2010

    From 2010 you are looking at a different process
    Apply for National Insurance credits if you’re a parent or carer (CF411A) - GOV.UK (www.gov.uk)

    I started working since year 2007 but the HRP and CPC is applied for my wife who was staying home looking after our child.

    As the child benefit is under my name, the HM & Custom office has rejected the application for NI credit of my wife saying that she is not receiving child benefit.

    I'm not clear whether you mean you started working in 2007.
    As you can see from my earlier post there appear to be different rules for years before and after April 2010.

    Yep - the person who claims child benefit gets the benefit.  I found this out by applying (as a grandmother) for caring for my grandchild.  Turns out I claimed via my DIL, but it was my son who was receiving CB, so I got nothing.....

    Hi Calotti
    While receiving child benefit under my name when I was working, my NI credit was earned by my work and deducted from my salary. Is there separate NI credit for child benefit that I can transfer to my wife ?

    If I transfer my NI credit earned from my work to my wife, then I will have less qualifying years for myself.

    When in work you are getting  CLASS 1 NIC

    Child benefit gives CLASS 3 credits.

    So, yes there are separate credits for child benefit.

    Hi himalgrg,

    I'm in a similar position to you. When our first child was born (2006), the Child Benefit was in my name even though I was working full-time and my wife was a stay at home mum. I only found at about NI Credits transfers a few years ago. 

    Your wife can apply for Home Responsibilities Protection (up to 2010) and then Class 3 National Insurance credit until the child turns 12.

    The process is quite simple if your wife has a Government Gateway / Tax Account. She can ask to backdate the first claim, and then would need to make a claim for each future tax year until the child (or youngest) turns 12.

    My wife has therefore gained 12+ years worth of National Insurance contributions as we had more kids later. 

    I never bothered to officially move the CB into her name.
