Item bought and paid for on ebay now re-listed.

I won an ebay auction last Monday and paid for the item within minutes. The listing said the item would be dispatched with a courier for tracked 24 hour delivery. The next day, Tuesday, I received a message from the seller saying the item would be dispatched the following day (Wednesday) and I should have it by the end of the week. 

Today I decided to check direct with the courier company and was informed that they had not received the item. I have emailed the seller to ask what is happening. No response as yet. Meantime I looked through the sellers other items and was surprised to see the very same item has been listed for a Buy It Now price higher than my winning bid. It is unlikely that the seller has two of these as the description of where it was bought and when are identitical. I also checked the sellers feedback and he has a few negative feedbacks about non delivery and relisting of items. 

Annoyingly, it appears possible for sellers who are courier account holders to book a collection, get a tracking number and it can be registered on ebay as dispatched. 

As I understand it, I can ask Ebay to get my money refunded when the delivery time expires (which is tomorrow). I do not think I can force the seller to send me the item. 

Any tips please, just in case I've missed something. I do not find ebay the easiest site to navigate.

    Unfortunately you are correct, you cannot force seller to send your item but can of course get a refund.

    If seller doesn't respond to you at all I would seriously consider leaving poor feedback after you get your refund as a warning  to the next buyers. make sure you don't mention any ebay case, something saying buyer did not respond and that item was relisted for a higher price.

    I think this os also against ebay rules (and certainly against auction law) so may bevworth complaining to ebay

    Yes it can be, it isn't obvious and OP may have to fiddle around with the original emails etc to find the way- but it can be done. That is proved by the line in the OP that says " I also checked the sellers feedback and he has a few negative feedbacks about non delivery and relisting of items."

I have now received a response and informed that the reason for non-delivery is that the courier failed to collect.  Offer for me to cancel and receive refund or ask for item to be re-sent. I have asked the seller to send the item. I will see what happens next. Does anyone know how many non deliveries and re-listings might get ebay to remove a seller or give some kind of warning? The negative feedbacks were in the last month or so.

    There is nothing automatic that ebay do if seller re sends, ebay only act if sellers get too many warnings for any reason, and a re delivery attempt will not trigger a warning.

    Hi, eBay isn't that difficult, especially if you do every single notification and message via their emailing system. Then if and when buyers or sellers complain, they have a complete history to peruse right there in your eBay email account. And the 100% moneyback guarantee applies. 

    On your eBay account page there's a heading 'Help & Contact' which is (in my experience anyway) very helpful.

Nothing happened other that the seller telling me the item had been dispatched and then not responding when I asked twice (once through the "my item hasn't arrived" option) for the tracking number. I have, however, received an offer of a big discount (but more than I have already paid by winning the auction) on the re-listed/identical item!! 

    Would appreciate some advice please. I have read through the policies and I think the seller is in breach of more than one. I can ask eBay to step in tomorrow. Which option do I tick - item not received, I need eBay to step in or the seller has violated policies? I can only tick one. Although it looks like all three apply.

    Possibly, by offering me a big discount on the Buy It Now re-listed item (which has never actually been dispatched), the seller may have made it difficult to refuse to now send it. If possible, I want the item. It will be obvious to eBay (and everyone else) that even if the item currently listed with a Buy It Now price is not the same item it is, nonetheless, identical in every single respect and I will be happy to accept it in place of the one that I won on the auction.

    Just get your refund at point of escalation (INR) first, that’s the important bit. If the seller is sensible they will refund you before that point as if eBay step in and refund the seller gets a strike and loses the FVFs on the sale. You cannot however force seller to send you the item.

    After you have your refund you can then still report the seller using drop down menus by the sale, at that point you can also leave feedback. Do not mention cases or eBay intervening when you leave feedback though.

    Take the money and run, the seller is a messer, I know you really wanted the item up for sale but hand on heart do you really think you are going to get it?
    Alternatively, if you speak to eBay, they can contact the seller for you, that might stir the seller into action.

    PS I always check out a sellers feedback before I purchase stuff on eBay.
