Good to post back with the result. I do hope you realise you have been very lucky and CEX have been generous to you.ctsoton said:After complaining via Twitter, I have received a full refund.
Whilst this thread has clarified what my statutory rights are or were, I dispute the idea that I was "lucky", by that logic anyone that takes advantage of a "goodwill" returns policy is "lucky".0 -
They are, because as the name suggests, it's goodwill. The refund does not have to be given.ctsoton said:theonlywayisup said:

I understand perfectly fine. I think what you guys fail to realise is that there's a difference between policy and practice. There are always valid exceptions to the rule / letter of the law.
It's irrelevant, I got my refund as I was sure that I would.0 -
That is pretty much the dictionary definition of lucky. An even that was outside your control went in your favour.ctsoton said:theonlywayisup said:

You have no idea of my opinion/realisation on policy v practice as I haven't expressed it.ctsoton said:theonlywayisup said:ctsoton said:theonlywayisup said:

If you were sure you would get your refund, why did you ask advice on here? But it isn't irrelevant as it may help someone in a similar position to understand you have no statutory right to a refund when you buy in store. Goodwill or not. It is down to each store to state their policy in such circumstances, but there is nothing in law that says you are due a refund for dumping an item on the counter and leaving the shop.
Suffice it to say, you've been lucky and CEX have been generous.3 -

As a site for Money Saving, its a positive result for the OP.You have no idea of my opinion/realisation on policy v practice as I haven't expressed it.

It is worth noting for future, that some CEX stores are "franchise" (not owned by CEX, albeit run at a short arms length). Not clear if this was a main branch or franchise, and whether it made a difference (i suspect a franchise would have been harder).Peter
