Letting someone live rent free, now i want to sell.

    It's like one of those stories which end...and with a single bound he was free. 

    I guess there may be others in the same/similar boat so would be helpful to know how it was solved. Did the girlfriend just move out? Did she buy the house? What happened?

    Sorry first time i have used this  she was classed as a excluded occupier and has now decided to move in with her new bloke, so all good.

    IMHO there is insufficient information provided in this thread to confirm she is/was.

    Has she - and all her goods/possessions - actually moved out, please?

    For anyone else reading, the distinction is whether to occupant was a tenant (and thus able to avail themselves of the protections under the tenancy laws) or a licenced occupier.

    If they paid rent (including rent-in kind) they are likely to be a tenant - even if no formal tenancy agreement exists.

    If they paid zero rent then there could still be a tenancy in place - for example, if they had exclusive occupancy. 

    If you are thinking of letting anyone live in your property 'rent free' then be very careful and get legal advice.
