Scammer problem

A week ago I fell victim to a phone scammer. I’m with Co-op Bank, and as soon as I realised I contact the, and they cancelled my Debit Card etc. I also changed all my Bank Account passwords and downloaded Norton 360. In short, I followed all the Banks directions to secure my account from further fraud.  Fortunately, at that time I didn’t lose any money. Today, I looked at my Bank Account and noted that £12000 had been taken out. I immediately call Co-Op and reported it. They have now started an investigation. I asked the Bank how this money had been taken from my account, and they said my Debit card was used on 16th February. They expressed surprise that the transaction was authorised and have said, that they do not believe that this has ever happened before. (I only have a £200 overdraft facility). They also said that the transaction took place on 16th February, but had only just been cleared. My query is this, if the Bank blocked my Debit Card on 15th February, but allowed a transaction to be placed on it on 16th February - when they knew there was fraudulent activity on my account - surely they are liable for the ‘loss’ of £12000? At present, they are investigating and will not tell me if they will be refunding  this overdraft of £12k, or if they will be deciding I am liable to pay it  back. Anyone got any thoughts ?

    If they can't prove that you authorised the transaction (or were negligent) then they're liable for it, regardless of what else was going on at around the same time:

  • It could have been a pre auth from before the card was cancelled.

    Either way, you need to wait for the outcome. No point in pre judging it yet.
