Solicitors cannot find details of a Land registry restriction on my property

We are applying for equity release. Our solicitor found a restriction from way back in 2006. The bank that placed it ( via a large legal practice) has since gone out of business.
The firm of solicitors that arranged the restriction split up into two new LLC,s, in 2010,  each one is now blaming the other for being unable to find the details of my restriction. So far, this has been going on for 6 weeks.
I paid off the bank back in 2006, but have no receipt for this.
Land Registry are requesting a proper authorisation from the original solicitors.
Who placed the restriction

    What sort of restriction?
  • It says:  No disposition of the registered estate to be registered without a certificate signed by the applicant. The ( bank) care of (solicitor) being the person with the benefit of an interim charging order on the beneficial interest of ( my name ) at  ( County Court) in 2006

There is the solicitors reference number and the court  reference number
  • You could try approaching the bank?
  • The bank was closed on Dec 1st 2010. ( as shown in government records)

If you have paid off the amount you owed under the charging order, you could apply to the court for the order to be discharged.  You will need to include evidence of payment, so you'll need to find out who now has taken over the debts from the closed bank.  Perhaps look on Companies House?  Once you know who you need to write to, let your solicitor have their contact details and they can write to obtain the required evidence from them agreeing to release the charging order from the title.
  • This was sadly 16 years ago , I have no record of payment .  The bank I paid the money from was a business account, and that was closed years ago. Banks don't keep records of closed accounts. In any case the LR wants proof signed by creditor ( closed) or his solicitor.( arguing over who is responsible!)
Funnily enough, I had an unexpected call from one of the two solicitors ( the one who is the most likely to have the records, and who yesterday was adamant that they had searched everwhere).  They have agreed to have a look in some further archives.
Very strange that. I had threatened to start proceedings in court, next week, as I have reasonable proof from reference number on the LR entry that it was one of them!
