Conduct of Employment Agencies and Employment (EAA) Business Regulations, 2003

Hello,

Long story short. I have been freelancing for a company for many years and am now being forced to go through an umbrella company to continue to get paid due to IR35.

The problem I have is that I also have a full time job and my employer does not know about my freelance work.

I have been asked if I wish to opt into Conduct of Employment Agencies and Employment (EAA) Business Regulations, 2003 by the umbrella company but I'm not sure if I can opt in due to my full time job.

Many thanks for any help.

Seems to be the same question you asked in July: https://forums.moneysavingexpert.com/discussion/6284398/umbrella-company#latest

Normally contractors are asked if they want to opt out...?

How much impact would opting in/out have on you? If the answer is 'not much', then probably not worth getting too worried.

Never a bad idea to read what your contract says about undertaking other work. If it doesn't conflict with 'the day job' and doesn't impact on your ability/availability, perhaps consider telling them (or asking them, as the case may be and depending on what your contract says).

Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!
