Offer on house subject to selling current house

In Scotland, is it possible to make an offer on a house subject to selling your own house?

We have seen a house we love and would be gutted if we missed out on it. The owner has indicated they would be willing to accept an offer with a long entry date to give time to sell our own house. Our current house is on the market but no offers as of yet.

My question is could we make an offer subject to our own house selling? And alternatively, if we made an offer with a long entry date, what would be the implications if we hadn’t sold our own house by the time that entry date came round? Would be penalised financially or be able to pull out?

    Yes, you can make it a condition of your offer that you've concluded missives for your sale - in which case there wouldn't be a risk of you being in breach of contract if you hadn't happened. But in practice, the sellers aren't going to conclude missives with that condition still there - and if you don't even have an offer yet, they're probably going to prefer marketing until somebody more proceedable comes along.
  • Yes, you can make an offer subject to anything.  But I wouldn’t expect the missives to be concluded before you’re ready to proceed. It will also make you less attractive to the vendor. If there are other interested parties, I’d expect them to choose someone who is in a position to proceed immediately over you.
