Would i pay stamp duty

I have just had an offer accepted on a house I will hopefully get my current house on the market this week if the new purchase completes before my current home would I have to pay stamp duty then apply for a refund. Thanks

    Depends on the timings. If it's just a small overlap - less than 14 days - you should be OK. Longer? Nope, pay and reclaim.
  • Presumably you are referring to the +3% SDLT. 

    If you complete on B before selling A you would pay the +3% SDLT and then claim refund (you can't claim a refund on the 'normal' stamp duty).

    If that happened, then yes. However can it happen? You'd need to be able to fund your purchase + SDLT without using any equity in your current house, so sufficient savings, bigger mortgage etc. In theory just for a short overlap, but if you don't exchange on the sale at the same time, then there's always a chance it can fall through and market can move / run out of time to claim back the SDLT. 
    Thats why, most people line up the sale & purchase, to exchange at the same time as the rest of the chain and complete at the same time as the chain.
