Unsuccessful POPLA appeal for Euro Car Parks - can I do more?

I was unsuccessful with my POPLA appeal for Euro Car Parks, which I have copied and pasted into the POPLA decisions thread. Does anyone know if I can progress this anymore? It does state that the POPLA appeal is final and now I assume the operator will start chasing me for payment. I also know these companies are unlikely to take the matter to court as it costs them more in the long run, or am I wrong in saying that if it went to court (eventually) I would only pay the initial cost of the PCN plus admin fee etc.
I have previously (but under different circumstances) appealed PCN's and was successful in some and not others (for the same set of reasons each time/was parked outside an old premised I lived at). 6 years on and every now and then the company tries to send me letters that they have passed to a debt recovery company, which I just ignore as I have no intention of paying! And this matter hasn't been progressed to court either...
Looking for some advice on this current one - many thanks

Actually these companies DO pursue to court , a lot , especially since the Beavis case , plus the pandemic too
You can weather the debt collector letters storm but ECP have 6 years to issue a court claim pack from the CCBC in Northampton , so the ultimate decision will be by a judge , or it times out !
A typical loss in court is about £200 , £100 PCN plus legal and court costs of about £100 , making the £200
A landowner cancellation is ALWAYS the best option !! ALWAYS3 -
Have you complained to your MP?You never know how far you can go until you go too far.0

Hello, thank you for the reply. I’m aware of the Beavis case as I have had it quoted many times in letters from companies pursuing PCN’s however the particulars have never related to my case as such! I will however re-review this.Redx said:Actually these companies DO pursue to court , a lot , especially since the Beavis case , plus the pandemic too

The Beavis case has ramifications for ALL cases , one way or another , especially if the claimant has complied with POFA , plus some other legal precedents can apply , so dismiss the Beavis case at your peril
Complaining to a landowner is never too late , hence why it's plan A in the newbies thread , appealing is plans B & C and court is plan D. Morrisons cancel these all the time , for customers !!
Parliamentary rules stop people contacting any MP other than your own constituency's MP , your local MP , although I believe that people can write to cabinet ministers if appropriate. Your first point of contact is your local MP , who you can ask to copy in other MP s as required. Respectful etiquette if nothing else !
So when Mr Deep said YOUR MP , he meant exactly that
Do the government consultation today or tomorrow , if not done already , it ends on Friday morning
Currently you are heading for plan D , if nothing else is attempted , so please remove the blinkers !4 -
As above ... Plan A is available at all times. Even if the PPC has initiated a court claim you can follow Plan A ... in that case it won't lead to a cancellation, but you'd have evidence for your defence/WS that the landowner doesn't want their agent to pursue this PCN.

The earlier you follow Plan A the more chance there is of success.Jenni x4 -
Thank you all for your help!! I will complain to the land owner who I assume is just Morrison’s - do I address to the store?!Also do I need to write anything specific in the request to the landowner eg I followed the newbies template for the appeal to POPLARS (which I found thoroughly confusing which is probably why I lost my appeal
)
or do I simply write to them with the details of the PCN and state what I stated in my initial appeal to Euro Car Parks? Apologies for the questions but from reading other threads, many people find the newbies thread a bit confusing to navigate.0 -
Sorry meant POPLA 😆0

You tell them (best to write to the CEO) that your last ever trip to Morrisons where you spent £xx.xx and have done weekly for years has been spoiled by their predatory parking minions and you can no longer afford to shop there if every trip comes with a surcharge of £100. If, however, they instruct the bloodsuckers to cancel the PCN you will reconsider where you shop.4

I have left this to the wayside (dealt with some recent personal circumstances) and received now two letters from a debt collection agency, they want me to pay £155 with no explanation of why it has increased from the £50 (if paid with 14 days) or £80 if paid after that date. Tbh the amount they could charge in court if they decided to take it would not be much more than that anyway….what are my chances they will do this?! 🤷🏼♀️ It was Parking Eye so not sure of their history.I’ve had other private parking companies pursue me for nearly 6 years sending debt collection letters every now and then and I’ve never paid (I basically won some POPLA appeals and not others even though circumstances were the same), never bothered paying as I didn’t feel they had grounds. Truth is with this one, I did overstay but I was working in an unfamiliar area and simply forgot to move it. Hence the ticket. Apologies just looking for some further advice really ☹️ Thank you1
