Help with Section 75 rules

Hi everyone
I’m currently in a dispute with our builder. We are building a new self build property and instructed a building company to construct the shell.
They provided us with a full breakdown of costs in the form of a document at the start which detailed the cost per stage of the build.
Unfortunately there was no official “contract” signed but obviously a verbal agreement to works starting based on those costings.
Throughout the build process we have made stage payments mostly via bank transfer however we did make two £5000 transactions via credit card.
Unfortunately last week we came to a point with the builder where he presented us with a sudden bill for “extras” costs that they had occurred over and above the original quote and threatened to walk off site if this wasn’t paid by midday. My partner had a meeting with the owner and agreed the extras figure and discussed the next stages of the build process and what was to happen next. On the assurance of them continuing the build we paid the “extras” bill which was a further £8800 on my credit card.
Then yesterday (Tuesday) once the card payment must have cleared he has now walked off site anyway.
We believe that we have to compare works completed on site vs the amount paid against the breakdown of costs provided to us by them.

My question relating to the 3 credit card payments made for effectively goods/materials/services not received is do I have any cover from my credit card provider under section 75?

Any help or advice would be very much appreciated

Thank you

Presumably you paid them by credit card directly rather than via PayPal or such? Just conscious that many builders don't accept cards but then with the sums involved its not a small one man band.

What is the total quote including the £8k? Remember that S75 only applies to total purchases under £30,000

Goods/services not received opens up chargeback as well as s75, for what was paid by card:

    What is the total price?
Over £30K and the is No S75 cover.

S75 is not on what you paid on the credit card, but the total value of the build.

There maybe some chargeback rights. But you would need to prove (invoices etc) that your CC payments were for materials that have never been received.
Not going to be a easy case to prove.
