Euro Parking Services Jewellery Corner Birmingham

Hi guys. I was reading an old post last night that was discussing EPS at the Chamberlain Buildings here in Brum last night. In December 2019 I was issued a PCN for parking in the blue badge bay, which I was and still am entitled to do, but I forgot to display my badge. I appealed by email but received no reply. I think they wrote again. I appealed again, heard nothing so assumed my appeal had been a success.

Then in March last year I went to the same Tesco and there was a big white van occupying the disabled bay. There was nowhere else to park so I left my car in an unmarked area but not causing an obstruction. I have very limited mobility - even short distances cause extreme pain. I got another PCN. I used the MSE template letter to appeal and heard nothing. Again I assumed that my appeal had been successful.

Yesterday I received a "Letter Before Claim" demanding I pay £320.00. Not only am I officially disabled but I also have severe depression. This isn't helping. Can anyone spare some advice please? Especially people who've dealt with EPS and their solicitors, Gladstones of Warrington, before

    Start by telling the scammers and scamlicitors, "Although I deny the debt I am seeking debt advice therefore I require you to put my case on hold for thirty days."


    Then send a landowner complaint and complaint to the manager and CEO of the Tesco store being visited.

    Excel v Wilkinson


    At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

    You need to make a complaint to the landowner about disability discrimination and failure to make reasonable adjustments under the Equality Act.

    You are about to be sued and the case is winnable but the landowner can cancel it, and should do. 

    Send the complaint also to Gladstones and Euro, and attach proof of your disability.  Also explain that you not only have a Blue Badge but you have very limited mobility - even short distances cause extreme pain.

    Cite the Equality Act duty to make reasonable adjustments and their failure.  In both cases you appealed so they know you are disabled and should have cancelled both PCNs and in the second case there were no grounds to lawfully charge you, because the disabled bay was blocked and the parking firm not only failed to keep it clear for drivers like you but they also attempted to profit from the situation by trying to charge you for having to park to one side.
