Received Judgment for Claimant but can't pay

Hi,

This is my first post here and I have no idea what to do :-(

I received a parking fine in Dec 2019 for a private car park from Civil Enforcement.  I (stupidly) ingnored this and heard nothing else until yesterday (14.04.21) when I received a Judgment for Claimant!

I have no idea what I need to do now, and I cannot pay to total that they are asking for!

Could someone please advise me?

    What you don't want to do is enter into any sort of payment plan because that will trash your credit record for six years!  I am assuming it is a court order giving judgment not just a claim form?  If so, what is the date by which you have to pay the amount?  If it is a CCJ then the only thing you can do is to apply for a set-aside; do you think you have a chance of defending the underlying claim?  Did you receive a LBC/LBA and then a N1 claim form?  If so, why did you ignore them?  If not, have you moved and not updated DVLA with the address on your V5C?
  • The judgement is dated 12th April and it says I have to pay within one month in order for the CCJ to not be registered.  I looked into getting the judgement "put aside" but I cannot afford the £255 fee for this.  
    I have never received any other correspondence and have lived at the same address for over 20 years, so the only thing I ignored was the original parking fine when I received it in December 2019.

    If your on any kind of means tested benefit you may be entitled to help with court fees.

    If you did not receive a letter before/of claim, the PPC/solicitor have failed the pre-action protocol and that is a good reason for having it put set aside.  If you didn't receive a N1 claim form and you have not moved, suggest you phone CCBC in Northampton and ask when and to where they sent the N1.  Amazing that the LOC and the N1 didn't make it to your address but he judgment did.  Have a read of the NEWBIE sticky second post about set-asides and what you need to do.  Read also some posts by @henrik777 and do the investigation work about help with fees.  If you win the set-aside case, it is possible that you will get back the fee if the claim form was not served correctly.  Keep on top of this as there is a limited amount of time to sort it now you know about it.

    But paying it off will be more and you won't get that money back.  Why would you pay MORE than £255 to get rid of it, but can't afford £255 which is a fee that you might be exempt from anyway and if not can possibly get refunded by Order of the court?

    Whereas set aside normally sees the £255 ordered to be refunded, in parking cases (see the examples of how to set aside a CCJ, in the NEWBIES thread).  SETTING ASIDE A CCJ DOES NOT INVOLVE PAYING IT AS WELL!
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
