Estate Management company question

We own our house but it is on an estate managed by an estate management company. We have an end of terrace house and alongside our outside wall are some hedges that are maintained by the estate management company. The problem is that we need to get the wall rendered as there are cracks and damp is getting in. We have spoken to them about removing the hedges so we can render down to the ground but they are being difficult about it. I would like to know where we stand legally as we think the roots from the hedges may have caused the issue...Does anyone have experience of anything similar? We will be getting advice from CAB and a solicitor if needed. Thanks

Your description of the problem isn't 100% clear, but there are two potential avenues here:
- If their hedges are causing damage to your wall, this is a legal nuisance and you can sue to repair damage that occurs after they have been put on notice, and/or an injunction to stop it continuing.
- if their hedges are merely obstructing access to your wall for repairs, then you are looking at the provisions of the Access to Neighbouring Land Act. Again, you can sue to get an injunction for access.
Suspect a solicitor's letter would be enough.0
