Parking Eye

My parking eye ticket has been sent to small claims court and the claim has been stayed as they didn't reply to my appeal within the time scale
 They have now written to me again so i appealed to them again. They have now offered to accept £135 as a goodwill gesture. Not sure what to do now as if the continue to pursue the claim may end up with further costs. Any advice

    Have you read the newbies?   Have you complained to the landowner?  Have you complained to your MP?  Have you read any others of the thousands of threads on here about PE?

    They only claim £175 or thereabouts in any court claim , £200 tops

    Just wandered if it would be better not to accept their offer and hope they won't lift the stay. I overstayed the parking by 1hr 38mins. It was at a hotel where my daughter was having a meal. I only went to pick her up but when I got there she was ill so couldn't leave straight away had to wait for her to be fit to travel. My concern was to get my daughter home and didn't see the parking signs. It was a genuine mistake

    That sounds like any contract was frustrated
    You may have a chance with that; it is not a mitigsting circ, it is a legal doctrine thast basically says due to sommething outside of your control (illness) you couldnt leave as you had planned.

    It costs them money to lift the stay.  Work out what it will cost them versus what they are likely to gain if they win the hearing.  Only the PPC can know what they will do.

    £100 to lift a stay
    Unless, of course, the stay expired if they did X, and they have done X. We dont know, as you have not given us the exact text of what the court ordered.

    You do know that you didn't 'appeal'?  You were meant to defend the claim.  It wasn't an appeal it was a court defence. 

    Please show us what you put, word for word.
