title deeds - bin storage

our title deeds show a small piece of communal land ( management org ) at the end adjoining our garden a section for a bin storage area for 3 flats.
the estate was built 1980 and this area has always been communal and bins stored by people's front door
now the management org want to build a bin storage area in the designated area - can we fight it as it has been untouched for 40 years and by building it now ( as each flat has 2 bins unlike only 1 in the 80s ) it will need to be bigger than on the original deeds

So presumably you are a leaseholder. Essentially, you need to read your lease to see if there are clauses that allow/prevent the communal land being used for bin storage. (The lease probably won't explicitly say that the communal area mustn't be used for bin storage, but it might say something more general which means it's not allowed.)
Are you being asked to contribute to the cost of building the bin storage? If the bin storage is considered to be 'an improvement', most private sector leases don't require you to pay for improvements (but council/HA leases often do). So the leaseholders would have to voluntarily agree to pay for the bin storage.

I assume 'title deeds' = your leasehold Title Plan?Worth looking also at your actual Lease Plan, as well as wording in the lease.But if, as you say, this land is designated in (one, the other, both) Plans as a commual bin store area, then the freeholder/their management company can use it as..... a communal bin store area.0

When you say it will need to be larger, would it encroach into your land?Or are the management company thinking about communal bins, rather than individual for each flat? That can lead to one person not squashing cardboard boxes leading to overflowing bins and annoying everyone so your neighbours might not like this either.But a banker, engaged at enormous expense,Had the whole of their cash in his care.
