Letter of Claim from BW Legal they have appear to have taken over from CST Law!

- I received a "Letter of Claim" letter last week regarding a PCN from a private car park in 2016
- This letter was from BW Legal but previous letters were from CST Law
- The gist of the situation was that
- I used a parking app to make a last-minute minute booking using a '''Last-minute'' feature booking & paid for the slot
- Conkai then sent an email after I had departed to the destination saying I could only park in certain numbered bays so I did not see this when parking
- This was not made clear on the webpage in the parking app
- and I have screenshots of the webpage that show this was not made clear
- and it was not made clear that you had to read a follow-up email from them telling you where to park in their car park!
- I was advised on this forum to include wording to the effect that this flouted the law on distance selling regulations
- which I did in the email to both Conkai and CST
- I have the original ticket
- I contacted the online parking company with whom I booked the slot and they said they could do nothing at the moment
- I contacted Conkai & CST Law and asked for a SAR as as the above from last summer 2020 advise
- - Subject Acess Request - they never replied by email or letter
- I also used the suggested wording on the forum disputing the debt
- As I now have a Letter Of Claim
- Could you advise as to my next steps, please?
- Should I dispute the matter with an email sent tonight as I did before covering steps 3 to 14 above
- and ask for a SAR again?
- Or am i looking at defending a Court Case?

Because they used a different company? WHy do you think it matters?
Have you read the newbies thread? That gives you a complete guide on LBCs4 -
you will get a court claim in due course.....3

As above , it's irrelevant who the claimant uses for debt collection or legal services
Await a Court claim pack from the CCBC in Northampton , that is what matters
In the meantime , you ensure a SAR is done , and replied to , if not already done
It's the court claim that matters , not the pre fight head butting4 -

This is perhaps an early indicator that CST Law are nothing more than part of the threatogram process where, with no success, litigation is passed further up the food chain to the likes of BWL who will continue the pressure, so let's see what develops.OP - you do need to deal with this as if it will get to court, although to date, Conkai are not recognised as a serious litigant. No room for complacency though, the whole PPC hunt pack are ravenous, being COVID-starved of 80% of their usual money diet!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

- I've emailed Conkai asking for a second SAR and stating that the first SAR I emailed them last summer they never replied to which I think is illegal?
- Then I emailed BW Legal as I did with CST Law and told them that I'm seeking debt advice and deny any debt and the case must be put 'on hold' for not less than 30 days under the PAP for debt claims 2017 and that I've sent their client a SAR and as I currently do not have enough information at present and confirmed my 'address for service'
- As a key worker, I've better things to be doing
- and wonder what the Court will think when they see how much time I've itemised that I've spent on this matter
- and that I've a copy of the original online parking company webpage which does not mention that I need to park in designated bays,
- that webpage it also did not mention I would receive an email telling me which bays I could park in after booking the parking
- or that failure to do so would result in a fine
- I've been told and I have the legal citation that this is a breach of distance selling law as the terms of the contract must be shown before payment and not altered or added to afterwards by email after payment!
- Is there anything else you can think of that I should do?
- Eg contact the DVLA and get a SAR from them of when they were asked for my details?
- complain to the regulator(s)
- Start billing them for my time

You are now involved in a tangled web of deceipt
BWLegal will not be interested in who you are, albiet a key worker, money is their game and nothing else
Conkai must respond within 30 days to your SAR or you report them to the ICO
BWLegal are obliged to obey PAP so they must give extra time for debt advice
The rest they will ignore or reply with nonsense
