Virgin Refund

I have had both BA and easyjet offer me 3 options incl for refund for scedule changes. (same days/diff times) and one included full refund which I accepted. Virgin However are not giving a full refund in the same corcumstances- the flight is LHR-MIA-LHR in Feb 2021. They are stating that change or voucher only. In both cases the flight involves a 4 hour differencr in schedule change. Can they legally refuse a refund?  The say refund only if flight cancelled. Any advice welcome !!!

Is it the same flight number and still direct or have they offered a new flight via another point?

According to https://www.moneysavingexpert.com/travel/flight-changes/#airlines, Virgin only consider a 12+ hour change as significant (to trigger refund rights), whereas BA and EasyJet apparently use 2 and 5 hours respectively, so it's not a one-size-fits-all situation....
