Hello,
I have just received a PCN for an alleged breach of T&Cs in a privately owned car park (Happy to disclose the management company). I can offer the following information
Our total time in the car park was 11 mins 25 secs
My girlfriend was suffering from anxiety and needed to take some air so we pulled into the car park so that she could do so
We didn't actually park the car in a parking space at all
We were not there long enough to read the T&Cs and decide to accept any contract to park
The whole time we were there, an attendant or engineer had the machine open so it would not be possible to buy a ticket in any event.
Can somebody advise please?
Thanks

Happy to disclose the management companyWhy conceal it then? Parking companies and their poodle trade associations have squeezed the amount of time you have to read the T&Cs and decide whether to stay or go to just 5 minutes.
What was wrong with stopping on the street, even on double yellow lines (unless there are 'blips' on the pavement edging blocks)?
Have you read the NEWBIES FAQ sticky, first post, yet? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Follow the same guidance you received when you dealt with that Sainsburys parking issue a couple of years ago.4

Would that still apply Keith? OK
I only concealed it in case that would be the advice, happy to disclose if required by somebody that can help
I was on a busy street , nowhere to park other than on a roundabout. The car park was right by0 -

I've just checked the Sainsbury case 2 years ago and the advice then was write to the CEO. I don't know who owns this car park

You didn't advise that :-) Euro Car Parks0

The fact that you don't know doesn't change our advice
Plan A is best , because you have no plan B1 -
OK so are you saying find out who owns the car park and then complain?0
-
That is always the best option , ALWAYS !!
The story you posted earlier has no legs as a defence to a breach of contract by being onsite for that period2 -
Oh. I will ask ECP who owns the car park
£100 is ridiculous for 11 mins when I couldn't have bought a ticket anyway
