  • I cant see if this was discussed, but do you need to declare the drivers identity to the entire world? Do you gain an advantage from doing so, or is it already known to the PPC? 

    IF NOT then edit your post, NOW :)
    It's already known unfortunately, I tried to appeal the PCN back when it happened and think I admitted to being the driver back then.

    Nicely done Fruitcake. These images will support the defence in the Witness Statement. Posters should never underestimate the importance of images. 

    In the Vine case the sign was obliterated by a high vehicle (Range Rover I think).  This case was heard at the Court of Appeal so influential. The Vine case and the images should support your case in the WS.

    With a Claim Issue Date of 26th October, you have until Monday 16th November to file an Acknowledgment of Service, but there is nothing to be gained by delaying it. 
    To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an AoS, you have until 4pm on Monday 30th November 2020 to file your Defence.
    That's almost four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.
    I went to file my defence earlier this week but the MCOL site kept coming up with error messages, and said my claim number and password were incorrect when I tried to log in. Are you sure the deadline would be the 30th? 
    Last Monday (23rd) would be 28 days from the claim date, however reading the document about submitting an AoS it says there is an additional 5 days for service dates, which makes 33 days... So if that is the case, yesterday would have been the deadline? 
    I emailed my defense to them yesterday but can't get anywhere on the MCOL site, is that a problem?
    If I have missed the deadline by 5 days, is that also a problem? 
    I will be calling their helpline first thing on Monday but if anyone can put my mind at ease until then I would be so grateful!

    @KeithP doesn't make errors on critical dates. 'Yesterday' was Saturday - a non-business day, so the next business day is Monday and is correct in my calculation. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Thanks, I thought this might be the case but just wanted to be double sure. Panic got the better of me!

    I am still confused as to why the MCOL site is telling my my details are incorrect though and that I can't submit the defence through there. Is this a common issue?

    You don't want to submit your defence through MCOL.  If you have sent it by e-mail using the address that you will find if you follow the links provided by @KeithP and have received an auto receipt, that should be fine.  If you haven't sent it to the e-mail address provided, do it now and stop trying to do it on MCOL.

    Why were you trying to use MCOL to file a defence that won't fit there?  You have our advice on how to file a defence and you don't now try to put even a full stop in on MCOL, otherwise that becomes your 'defence'.

    Email is precisely how you have been instructed to file. 
    The newbies thread cannot be more clear on this. Cannot be 

    no idea why your details are wrong. Cannot possibly help you. Do it through the website. But email the defence. 
  • For some reason I had it in my mind that I needed to submit the defence using the site, and send an email as a backup. I've sent the email though so should be all ok. Thanks again.
