Any Risk Claiming Injury Via Third Party's Insurer

Hi

I have sustained an injury in a motor accident with the third party admitting liability. The third party insurer has been regularly contacting me about claiming personal injury directly with them. Are there big disadvantages to going this route rather than going through my own insurer? Naturally I'd imagine the third party would try and minimise any payout as much as possible whereas my insurer would be working in my favour but are there any other things I should consider. It's just my insurer has been a nightmare to deal with so far and it's becoming really tiresome just getting to the right department to speak to that I would now rather deal with the third party insurer directly.

If I do through the third party, is there a point I cannot back out and go back to using my own insurer?

    If you claim for injury through your own insurer they will likely pass it to their solicitors, which can be a long winded process. 
    If you go through the third party insurance directly they will look to pay you directly, this does save them money yes, but not because they will pay you less, it saves them money because it saves the solicitor fees etc. You can haggle directly with them and it’s likely they will want to appease your wishes within reason to keep you from going through solicitors. 

    Give them a call and see what kind of offer they are looking to make. If you don’t think it’s acceptable then call your insurer and find out their process for claiming for injuries

    I did it. I was happy with their offer. They were aware that they could become liable for my legal fees if I had to take them to court so they made a reasonable offer. It's fairly straightforward to find out what is reasonable based on the nature and duration of the injury.

    I think if its minor injuries then going direct to the third party is an option. If it is a serious injury you may be better going to a solicitor who can fight for the right amount of compensation. If you have legal cover then you may not need to pay a percentage to the solicitor. 
  • The case for claiming compensation under third party will be filed against you and your insurer. While there is no limit on the liability covered for injury or death.
